A decisão do julgador precisa se reportar a elementos de prova produzidos no juízo penal. Há, no entanto, elementos hoje previstos em lei, (art. 59, do Código Penal) que não devem ser valorados, porque não dizem com o fato em julgamento, que é anterior e exterior ao processo. Assim, a postura do acusado durante o processo, pelo exercício do direito ao silêncio ou por ter dado sua versão dos fatos, em pleno exercício do direito de defesa, não pode ser valorada. Nem suas manifestações de autodefesa (gestual, postura). Desta forma, pode-se dizer que personalidade não pode ser valorada, porque não tem relação objetiva com o fato que precisa ser provado. Além disso, não pode servir ela, personalidade, de válvula de escape de arbitrariedades, sob manto de legalidade. Afinal, o direito penal brasileiro é o direito penal do fato, natural em um Estado democrático e de direito, e não do autor, típico de sociedades autoritárias. O direito penal e o processo penal são limitações ao poder punitivo estatal. A crítica final é sobre a falta de legitimidade para este critério continuar no sistema, de direito penal do fato e não do autor, tornando, de certa forma, o que era para ser limitado, ilimitado e um espaço para arbitrariedades e subjetivismo em detrimento da razão. Em outras palavras, defende-se que o acusado não pode ser penalizado por comportamento seu no processo, utilizando o julgador, para tanto, do critério da personalidade previsto no artigo 59, do Código Penal. Quer por seu interrogatório, quer por seu comportamento em audiência, dentro dos limites da lei e da ampla defesa, o julgador não pode utilizar tais comportamentos para majorar a reprimenda penal, com base no critério personalidade, vago, demasiadamente aberto, além de excessivamente subjetivo. Relaciona-se estritamente ao tema, o princípio do nemo tenetur sene detegere, especialmente o direito ao silêncio, aliado à presunção de inocência, bem como ao princípio da estrita legalidade, não só dos crimes, mas principalmente das penas e critérios legais de sua individualização e aplicação. Todos aqui analisados e, ao final, alguns casos são usados como exemplo de como a matéria vem sendo tratada no dia a dia.

The judge's decision must be based on evidences admitted at criminal court. There are, however, elements foreseen in criminal law, (article 59, Penal Code of Brazil) that should not be considered, because they do not relate to the fact in judgment, which is prior and external to the criminal process. Thus, neither the defendant's attitude during the criminal process, exercising his right to remain in silence nor his version of the facts, exercising his right of defense can be considered. Nor even the manifestations of self-defense (gesture, posture). Therefore, it can be said that personality can not be acknowledged as evidence, because it has no objective relation to the fact that needs to be proved. Moreover, personality can not be used as an excuse for arbitrariness, disguised as legality. After all, the Penal Code of Brazil is the criminal law of the fact, which is natural in a democratic rule-of-law State, not the criminal law of the author, typical in authoritarian societies. The Criminal law and the criminal process are limitations to the State punitive power. The final critic regards the lack of legitimacy for this criteria to continue in a criminal law system focused on the fact and not on the author, making it, in a certain way, unlimited what was supposed to be limited, and creating a space for arbitrariness and subjectivism in expense of reason. In other words, it is defended that the defendant can not be penalized for his behavior during the process, using the judge to do so, the personality criteria foreseen in the article 59 of the Criminal Code. Either through his questioning or through his behavior in court, within the limits of the law and the full right of defense, the judge can not use such behavior to increase the penalty, based on the personality criteria, which is vague, overly open, as well as excessively subjective. It is purely related to the theme, the nemo tenetur sene detegere principle, especially the right to remain in silence, together to the presumption of innocence, and the principle of strict legality, not only of crimes, but also of the penalties and legal criteria of their individualization and application. All here analyzed and, in the end, some cases are used as an example of how the matter is being treated daily.
