Esta dissertação de mestrado tem como objetivo compreender o contexto de criação da política criminal voltada ao enfrentamento da criminalidade organizada transnacional. A pesquisa inicialmente discorre sobre os motivos e circunstâncias da procura crescente por tutelar criminalmente determinadas condutas de forma conjunta e uniforme entre os Estados, conformando regimes globais de proibição. Em seguida, a pesquisa busca compreender a forma como esse anseio por regramentos penais transnacionais se manifestou tanto no processo de criação do conceito de crime organizado e crime organizado transnacional, passando a constituir tipos penais autônomos, assim como de ilícitos reconhecidos como dotados de caráter organizacional e transnacional, com especial destaque para tráfico de drogas, terrorismo, lavagem de dinheiro, corrupção e cibercrimes. Para isso, foi realizada a análise de discursos políticos e midiáticos, de debates acadêmicos e de normativas internacionais e domésticas, assim como suas justificativas, no tocante a condutas que foram criminalizadas sob a preocupação de controle da atividade organizada e transfronteiriça. Verificou-se uma profunda dificuldade na consolidação e restrição semântica desses ilícitos e uma ampla utilização retórica da ameaça do crime organizado para legitimar a expansão de medidas repressoras em detrimento de direitos fundamentais e da dogmática penal.

This masters dissertation aims to understand the context of the creation of criminal policy focused on transnational organized crime. The research initially discusses the reasons and circumstances for the growing demand for joint and uniform criminal protection of certain behaviors among states, leading to the shaping of global regimes of prohibition. The research then seeks to understand how this desire for transnational criminal regulations manifested itself in the process of creating the concept of organized crime and transnational organized crime, as autonomous species, as well as illicit activities recognized as having organizational and transnational character - with particular emphasis on drug trafficking, terrorism, money laundering, corruption, and cybercrime. To this end, political and media discourses, academic debates, and international and domestic regulations and their justifications were analyzed regarding behaviors that were criminalized under the concern of controlling organized and cross-border activity. A profound difficulty in consolidating and semantically restricting these offenses was observed, as well as extensive rhetorical use of the threat of organized crime to legitimize the expansion of repressive measures to the detriment of fundamental rights and penal dogmatics.
