O presente trabalho tem por objetivo analisar criticamente os fundamentos do direito penal moderno à luz do conceito de ideologia. Nesse passo, analisa-se o percurso teórico da formação do conceito de ideologia no pensamento de Karl Marx e, posteriormente, as principais interpretações do conceito no seio do marxismo. Após recusar as correntes de pensamento que negam o conceito de ideologia, resgata-se a formulação original de Karl Marx da ideologia como construção a-histórica e idealista que oculta, inverte e naturaliza uma situação de injustiça com a função de preservar as relações de dominação. Em seguida, expõe-se a forma como a doutrina penal alemã e brasileira reproduzem os fundamentos do direito penal para a posterior análise crítica a partir do conceito marxiano de ideologia. A reprodução dos fundamentos do direito penal pela doutrina penal tradicional constitui uma manifestação ideológica na medida em que incorre no idealismo sem cotejo com a história e generaliza aspectos particulares do fenômeno. Como consequência, oculta-se o papel do direito penal na reprodução das condições sociais de desigualdade e do racismo, de maneira a contribuir para a dominação de classe. Diante do quadro ideológico, cumpre fundar uma prática social transformadora que tenha como horizonte o fim da ideologia, e no presente a construção de uma política criminal que não a reproduza.

This research aims to critically analyze the foundations of modern criminal law in the light of the notion of ideology. In this way, the theoretical trajectory of the formation of the concept of ideology in Karl Marx's line of thought and later the main interpretations of the concept within Marxism are analyzed. After rejecting the currents of thought that deny the concept of ideology, the original Karl Marx formulation of ideology is rescued as an ahistorical and idealist construction that conceals, inverts and naturalizes a situation of injustice with the function of preserving relations of domination. Later it shows how the German and Brazilian criminal doctrines reproduce the foundations of criminal law for then critically analyze the Marxist concept of ideology. The reproduction of the foundations of criminal law by traditional penal doctrine constitutes an ideological manifestation as it incurs idealism without comparison with history and generalizes particular aspects of the phenomenon. As a consequence, the role of the criminal law in the reproduction of social conditions of inequality and racism, in order to contribute to class domination, is hidden. At this ideological framework, it is necessary to establish a transformative social practice whose final aim is to end the ideology, and at present will build a criminal policy that does not reproduce it.
