A dissertação pretendeu investigar e responder se e quando a tentativa é punível nos crimes omissivos, vale dizer, se aquele que não cumpre com um dever legal de intervir em um processo causal perigoso, imposto por um tipo penal, pode ser responsabilizado ainda que não sobrevenha um resultado lesivo ou perigoso de tal processo. Para tanto, iniciou-se com a elaboração de casos hipotéticos a partir de casos concretos julgados por tribunais brasileiros como forma de explicitar o problema de pesquisa e sua relevância prática e, na sequência, propôs-se, durante toda a dissertação, a solução destes casos, demonstrando a correta localização dogmática do problema em questão. Por fim, a partir de um método de pesquisa bibliográfico e uma metodologia argumentativa, foram expostas as posições doutrinátias que definem se há ou não responsabilidade penal por tentativa em crimes omissivos e, em caso positivo, sob quais pressupostos, e tomou-se posição fundamentada a respeito da impossibilidade da responsabilização penal por tentativa nos crimes omissivos próprios e da possibilidade, com delimitação dos pressupostos, da responsabilização penal por tentativa nos crimes omissivos impróprios.

The dissertation intended to investigate and answer if and when the attempt is punishable in omission crimes, that is, if the one who does not comply with a legal duty to intervene in a dangerous causal process, imposed by a criminal type, can be held liable even if it does not happen an injurious or dangerous result of such a process. For that, it started with the elaboration of hypothetical cases from concrete cases judged by Brazilian courts as a way of explaining the research problem and its practical relevance and, subsequently, it was proposed, throughout the dissertation, the solution of these cases, demonstrating the correct dogmatic location of the problem in question. Finally, based on a bibliographic research method and an argumentative methodology, were exposed the doctrinal positions that define whether or not there is criminal responsibility for attempted omission crimes and, if so, under what assumptions, and a well-founded position was taken regarding the impossibility of criminal liability for attempts to commit omissive crimes themselves and the possibility, with a demarcation of assumptions, of criminal liability for attempts to commit inappropriate omissive crimes.
