O presente estudo analisa criticamente a teoria do garantismo penal, a partir da formulação de Luigi Ferrajoli, com o propósito de destacar as respostas satisfatórias e as incapacidades que possui para tutelar direitos fundamentais. Para tal, esse trabalho inicia-se com a análise da crise de legitimidade do sistema Penal e com a apresentação de teorias que defendem a legitimidade do poder de punir e a manutenção do atual modelo. A seguir, com a inserção do garantismo penal no pensamento criminológico e com a descrição de seus axiomas penais e processuais, são trazidos os elementos que compõe o dever ser garantista. Diante de tal aporte teórico, são investigadas se suas características possuem condições de solucionar ou ao menos amenizar a crise de legitimidade do sistema penal. Para ampla compreensão do garantismo e para exposição do debate em torno da (i)legitimidade do sistema penal, são apresentadas, ao fim, as teorias que partem de um fundamento diverso da pena e que, por isso, consideradas deslegitimadoras da pena.

The present study critically analyzes the theory of penal guarantee according to the formulation proposed by Luigi Ferrajoli, aiming to highlight the satisfactory answers and the incapacities that it has to protect fundamental rights. To do so, this work begins with the analysis of the crisis of legitimacy of the criminal system and the presentation of theories that defend the legitimacy of the power to punish and the maintenance of the current model. Next, with the insertion of the penal guarantee in the criminological thinking and with the description of its criminal and procedural axioms, the elements that compose the guarantism ought are brought in. Faced with such a theoretical contribution, the work investigates whether the characteristics of the theory can solve or at least alleviating the crisis of legitimacy of the penal system. For a broad understanding of the penal guarantee and for exposition of the debate around the (i)legitimacy of the penal system, the theories that depart from a different foundation of the penalty and, therefore, considered as delegitimizing penalties are presented at the end.
