O presente estudo teve como objetivo principal estabelecer, por meio de uma revisão de artigos publicados em bases de dados médicos e mediante jurisprudências, uma abordagem médica e as repercussões penais relacionadas aos portadores de pedofilia. Para tanto, interrogou-se de que forma o direito penal, no âmbito internacional, vem tratando os portadores de pedofilia; se com medidas punitivas ou terapêuticas. A pesquisa fora feita em duas etapas, sendo a primeira elaborada com base na análise dos artigos relativos ao tema no PubMed e a segunda por meio de decisões colhidas no site do Tribunal de Justiça de São Paulo (TJSP). Demonstrou-se, nesta dissertação, que, a despeito de a pedofilia ser um transtorno mental, os dados comprovaram que em 65 acórdãos a palavra pedofilia foi usada como sinônimo de doença ou transtorno mental, mas em apenas 6 deles houve referência ao cumprimento de medida de segurança com internação em hospital de custódia e tratamento. Verificou-se, em paralelo, que nos artigos médicos internacionais referentes ao tema, foi possível encontrar estratégias e programas de tratamento e reintegração dos pedófilos à comunidade, além de medidas de prevenção e gerenciamento, conforme cada caso. Assim, foi possível perceber, pela leitura do texto, que não se pretendeu esgotar o debate acerca do tema da pedofilia, visto que não existe uma medida única que seja capaz de abarcar toda a problemática em torno da questão.

The main objective of the present study was to establish a medical approach and the criminal repercussions related to pedophilia patients through a review of articles published in medical databases and jurisprudence. In order to do so, it was asked how criminal law, at the international level, has been treating people with pedophilia: whether with punitive or therapeutic measures. The research was carried out in two stages, the first being based on the analysis of articles on the subject in PubMed and the second through decisions collected on the website of the Court of Justice of São Paulo (TJSP). It was shown in this dissertation that, despite pedophilia being a mental disorder, the data showed that in 65 judgments, the word pedophilia was used as a synonym for mental illness or disorder, but in only 6 of them there was reference to compliance with security measure with admission to a custody and treatment hospital. In parallel, it was found that in international medical articles on the subject, it was possible to find strategies and programs for the treatment and reintegration of pedophiles into the community, as well as prevention and management measures, according to each case. Thus, it was possible to perceive, by reading the text, that it was not intended to exhaust the debate on the subject of pedophilia, since there is no single measure that is capable of covering all the problems surrounding the issue.
