Esta dissertação, cujo objetivo consiste em precisar a responsabilidade criminal e integralizar os delitos funcionais, se propõe a analisar o artigo 327 do Código Penal, norma explicativa que traz o conceito penal de funcionário público. Visa à busca de uma interpretação que traga clareza e segurança na aplicação desse dispositivo. Para tanto, foram apresentados alguns parâmetros que restringem a atividade punitiva do Estado, sendo eles: o princípio da legalidade e demais postulados, o princípio da intervenção mínima, com enfoque no Direito Administrativo sancionador, e os métodos hermenêuticos válidos para a interpretação da lei penal. Foram também revisitados conceitos gerais do Direito Administrativo, incluindo a organização administrativa, em virtude da intrínseca relação com o tema. Feitas essas análises e estabelecidas as premissas iniciais, passou-se ao estudo do artigo 327 do Código Penal, identificando seus termos e apontando suas deficiências. Ao final, com fundamento nas diretrizes estabelecidas no decorrer do trabalho, propõe-se um novo conceito penal de funcionário público.

This thesis has the purpose of analyzing article 327 of the Criminal Code, an explanatory rule that brings the criminal concept of public officer, whose objective consists in specifying the criminal responsibility and integrating the functional crimes. It does this in search of an interpretation that brings clarity and security in the application of this legal provision. In order to do so, some parameters that limit the punitive intervention of the State have been presented, at wit: the principle of legality and other postulates, the principle of minimum intervention focusing on administrative sanctioning law, and the hermeneutic methods valid for the interpretation of criminal law. General concepts of Administrative Law were also revisited, including the organization of the Public Administration, due to the intrinsic relation with the subject matter at issue. Once these analyzes were carried out and the initial premises established, article 327 of the Criminal Code was studied, identifying its terms and pointing out its deficiencies. Finally, based on the guidelines established in the course of the work, a new criminal concept of public officer is proposed.
