Desde meados dos anos 90, alterações legislativas vêm sendo promovidas pelo Poder Legislativo brasileiro - influenciado, em grande medida, pelas reivindicações e pressões dos movimentos feministas - com o objetivo de melhorar a resposta estatal às distintas formas de violência de gênero. Nesse contexto, a via penal tem se constituído uma das principais ferramentas institucionais utilizadas para traduzir juridicamente tais demandas, o que se revela pela crescente criminalização de condutas "em defesa das mulheres", como a violência doméstica, o assédio sexual, o feminicídio, a importunação sexual, o estupro coletivo, entre outros. Partindo dos principais referenciais teóricos feministas acerca do conceito de gênero, o presente trabalho analisa a trajetória legislativa das aqui denominadas "leis penais de gênero" ao longo das três últimas décadas, de forma a identificar possíveis falhas do processo de criminalização primária, assim como estabelecer considerações político-criminais sobre o uso da via penal no enfrentamento da violência de gênero

Since the mid-1990s, legislative changes have been promoted by the Brazilian Legislative Power - influenced, to a large extent, by claims and pressures from feminist movements - with the aim of improving the state response to different forms of gender-based violence. In this context, the criminal law has been one of the main institutional tools used to legally translate such demands, which is revealed by the growing criminalization of conducts "in defense of women", such as domestic violence, sexual harassment, femicide, sexual harassment, gang rape, among others. Starting from the main feminist theoretical references about the concept of gender, the present work analyzes the legislative trajectory of here called "gender criminal laws" over the last three decades, in order to identify possible failures of the primary criminalization process, as well as establish political-criminal considerations on the use of the criminal law in coping with gender-based violence
