O presente trabalho dedica-se ao estudo do Direito Penal como comunicação, apresentando os fundamentos para a reconstrução do Direito Penal por meio da legitimação intersubjetiva do Direito, uma espécie de Teoria Geral do Direito que observa o direito como um fenômeno linguístico, comunicativo e intersubjetivo. O objetivo principal do trabalho é, na primeira parte, construir os fundamentos teóricos para uma nova Teoria do Direito e, na segunda parte, construir uma nova dogmática penal, denominada de funcionalismo comunicativo, por meio desta teoria, aplicando-a ao conceito de Direito Penal, aos seus princípios e aos elementos do conceito analítico de crime (ilicitude, tipicidade, culpabilidade e punibilidade).

The present work is dedicated to the study of Criminal Law as a communication, presenting the foundations for the reconstruction of Criminal Law through the intersubjective legitimation of Law, a type of General Theory of Law that observes law as a linguistic, communicative and intersubjective phenomenon. The main objective of the work is, in the first part, to build the theoretical foundations for a new Theory of Law and, in the second part, to construct a new Criminal Law dogma, called communicative functionalism, through this theory, applying it to the concept of Law Criminal law, its principles and the elements of the analytical concept of crime (illegality, typicality, guilt and punish ability).
