O presente estudo versa sobre a irracionalidade do sistema criminal sob a perspectiva da obra religiosa de Tolstói. Em sua obra "Minha religião", equivalente a uma releitura dos Evangelhos por Tolstói, o escritor russo, em alguns trechos, critica veementemente o sistema de justiça criminal, por intermédio de três refutações. De fato, para Tolstói, o livre-arbítrio seria uma ilusão e o Direito Penal seria completamente contrário aos ensinamentos de Jesus Cristo e também à própria razão. De acordo com Tolstói, não se apaga o fogo com fogo. Nesta tese, serão analisadas, uma a uma, as assertivas de Tolstói. O livre-arbítrio será estudado sob diversos prismas (teológico, filosófico, literário, jurídico e neurofilosófico). Após, será examinado se o Direito Penal é realmente contrário aos ensinamentos de Jesus Cristo, discussão relevante num país de maioria cristã como o Brasil e no qual, ademais, igrejas cristãs têm influenciado o Parlamento em temas penais, como o aborto. Por fim, a irracionalidade ou racionalidade do sistema criminal será averiguada sob o ponto de vista tanto da existência quanto do funcionamento. Encerrando o trabalho, algumas propostas legislativas serão formuladas, concluindo-se com a demonstração da importância da leitura de Tolstói para os juristas contemporâneos.

The present study deals with the irrationality of the criminal system from the perspective of Tolstoy"s religious work. In his work "My religion", equivalent to a rereading of the Gospels by Tolstoy, the Russian writer, in some parts, vehemently criticizes the criminal justice system by means of three refutations. In fact, for Tolstoy, free will would be an illusion and Criminal Law would be completely contrary to the teachings of Jesus Christ and also to reason itself. According to Tolstoy, the fire is not extinguished with fire. In this work, Tolstoy"s assertions will be analyzed one by one. Free will be studied under various prisms (theological, philosophical, literary and neurophilosophical). Afterwards, it will be examined whether criminal law is really contrary to the teachings of Jesus Christ, a relevant discussion in a country with a Christian majority such as Brazil and in which, in addition, Christian churches have influenced the Parliament in criminal matters, such as abortion. Finally, the irrationality or rationality of the criminal system will be investigated from the point of view of both existence and functioning. In closing the work, some legislative proposals will be formulated, concluding with the demonstration of the importance of the reading of Tolstoy for the contemporary jurists.
