Este trabalho pretende investigar a relação existente entre a História da formação da Academia de Direito de São Paulo e da elaboração dos seus discursos, especialmente no que se refere à pena e à prisão, e as condições de surgimento e desenvolvimento do aparato carcerário na cidade, entre 1822 e 1930, tendo em vista as formações econômico-sociais que lhes são (e foram) correspondentes. Tal percurso histórico-criminológico, por sua vez, parece plenamente justificável: afinal, é preciso conhecer intensamente o passado para que se chegue a diagnósticos mais ou menos precisos a respeito do presente. Fala-se, aqui, em um cauteloso trabalho de reconstrução da gênese de dois sistemas, cada qual em uma "ponta" da chamada Justiça Criminal - a ponta que sujeita e a que é sujeitada -, que coloca em primeiro plano, necessariamente, a questão estrutural. Por meio da investigação histórica séria e reflexiva, assim, pretende-se desvelar, uma a uma, as incrustações que as diversas ideologias - jurídica, filosófica, criminológica - depositaram ao longo do tempo sobre os alicerces das duas instituições a serem retratadas

This paper aims to investigate the relationship between the foundation of the São Paulo Law School and the development of its speeches, especially when related to punishment and prison, and the conditions for the emergence and expansion of the penal apparatus in the city, between 1822 and 1930, in view of the social and economic formations that prevailed (and still do) as their base. Such a historical-criminological course seems completely justifiable: after all, one needs to intensively know the past in order to achieve a more or less accurate diagnosis about the present. Thus, this paper structures a cautious reconstruction work of the genesis of two organizations, each of which at the edge of the so-called Criminal Justice, which necessarily prioritizes a structural analysis. By means of a serious and reflective historical investigation, this paper aims therefore to unveil, one by one, the incrustations that the several ideologies - legal, philosophical and criminological - have vested on the foundation of the two institutions discussed
