Os indivíduos estrangeiros condenados à pena privativa de liberdade no Brasil perpassam, desde o suposto cometimento do delito até sua saída do território nacional, por procedimentos administrativos e jurídicos peculiares. A ausência de um arcabouço normativo compilado e de políticas públicas estruturadas e específicas dificulta a concessão de um tratamento coeso a este público. Na busca pela compreensão deste universo, o trabalho investiga os ganhos e os custos sociais da pena privativa de liberdade para o indivíduo estrangeiro encarcerado na unidade penitenciária "Cabo PM Marcelo Pires da Silva", localizada na cidade de Itaí/SP. A partir de uma metodologia empírica indutiva, inspirada nas teorias da Fenomenologia Social e "Teoria Fundamentada nos Dados", realizaram-se entrevistas com os presos estrangeiros de Itaí, acessando suas expressões em face da intensidade do cumprimento de pena de prisão. A pena de prisão extrapola a privação da liberdade de locomoção para os indivíduos, chegando a atingir sua auto percepção como sujeitos de direito e sua capacidade de vivenciar o presente.

The foreign individuals condemned to the penalty of incarceration in Brazil go through peculiar administrative and legal procedures from the alleged committed crime until their departure from the country. The absence of a compiled normative framework and of structured and specific public policies hinders the provision of a cohesive treatment to these individuals. In the search for understanding this reality, this dissertation investigates the social benefits and costs of the sentence involving de privation of liberty for the foreign individuals incarcerated in the penitentiary unit "Cabo PM Marcelo Pires da Silva", located in the city of Itaí, state of São Paulo. From an empirical inductive method inspired in the Social Phenomenology Theory and "Grounded Theory", interviews were held with the prisoners of Itaí, evaluating their expressions in face of the intensity of serving a sentence of imprisonment. The penalty of imprisonment surpasses the deprivation of freedom of movement to individuals, affecting their auto perception as subjects of rights and their capacity to experience the present.
