Este trabalho tem como finalidade encontrar os critérios para a delimitação do alcance do tipo penal de estelionato. Após uma abordagem do conceito mais amplo de criminalidade de fraude, será feita uma revisão das teorias que buscavam distinguir a fraude meramente civil da fraude penal. Na sequência, será proposta uma perspectiva de estudo dos elementos típicos do estelionato. O primeiro elemento a ser analisado será o prejuízo, visto que este é o referencial de risco típico do engano penalmente relevante. Assim, por meio da análise da evolução histórica do conceito de patrimônio, bem como, consequentemente, das limitações das concepções pretéritas, será adotado um conceito pessoal de patrimônio. A concepção pessoal revelar-se-á adequada, pois, ao admitir a possibilidade de graus de personalização, vincula o prejuízo à frustração de finalidades intersubjetivamente estabelecidas. Ao final, serão expostas diversas teorias que procuram restringir normativamente o conceito de engano típico, das quais a mais coerente com o conceito adotado de prejuízo será a dos deveres de veracidade, visto que estes variam em função das condições da disposição patrimonial.

This work aims to find the criteria for delimiting the scope of the swindle in criminal law. After an approach to the broader concept of the fraudulent crime, a review will be made of the theories that sought to distinguish merely civil fraud from criminal fraud. After that, a study perspective of the typical elements of swindle will be proposed. The first element to be analyzed will be the property loss, since this is the referential of typical risk of criminally relevant deceit. Thus, through the analysis of the historical evolution of the concept of property, as well as, consequently, the limitations of the previous conceptions, a personal concept of property will be adopted. The personal conception will reveal itself to be adequate because, by admitting the possibility of degrees of personalization, it links the property loss to the frustration of the intersubjectively established purposes. Finally, several theories will be exposed that seek to normatively restrict the concept of typical deceit, of which the most coherent with the adopted concept of damage will be that of the duties of veracity, since these vary according to the conditions of the disposition of property.
