A presente dissertação tem como problema investigado o instituto do trabalho prisional, introduzindo a hipótese de sua utilização como legitimação do discurso dominante, porém falacioso, da pena privativa de liberdade, qual seja, a ressocialização. Para tanto, os seguintes temas são analisados, através de uma abordagem interdisciplinar com o direito, a sociologia e a criminologia, essencialmente: (a) o trabalho livre nas suas diversas acepções na história, com especial atenção ao atual contexto, de forma a traçar um panorama geral da dinamicidade de sua valoração social, por meio de revisão bibliográfica sobre o tema; (b) a origem das instituições prisionais e suas funções declaradas e latentes, com enfoque à prevenção especial positiva, na qual o trabalho prisional se insere; (c) o instituto do trabalho prisional, através de uma descrição histórica, de análise das legislações internacionais e pátrias e da realidade prática; (d) o sistema prisional brasileiro, fazendo uso de dados estatísticos, e como o trabalho prisional se insere neste cenário. Como objetivo geral, pretendeu-se analisar de que modo a valoração positiva do trabalho é inserida na execução penal. O instituto em comento é encarado, majoritariamente, como positivo e inconteste e, quando alvo de críticas, essas se concentram, no mais das vezes, na realidade prática de falta de vagas e parca diversidade no oferecimento e, em alguns casos, na não efetivação dos direitos sociais do trabalhador preso. Pretendeu-se, assim, aprofundar e inovar o debate ao trazer a crítica social do trabalho para a execução criminal.

The present research project has as a problem to be investigated the institute of prison labour, introducing the hypothesis of its use as legitimation of the dominant, but fallacious, be analysed through an interdisciplinary approach to law, sociology and criminology, essentially: (a) the free labour in its various meanings in history, with special attention to the current context, in order to general overview of the dynamicity of their social valuation, through a bibliographical review on the theme; (b) the origin of prisons and their declared and latent functions, with focus on positive special prevention, in which prisoners labour is included; (c) the prison labour institute, through a historical description, analysis of international and domestic laws and practical reality; (d) the Brazilian prison system, through statistical data, and how prison labour fits into this scenario. As a general objective, it is intended to analyse how the positive valuation of the labour is inserted in the criminal execution. The prison labour institute is seen, mostly, as positive and uncontested; when criticized, the focus is often on the practical reality of lack of jobs opportunities and lack of diversity in the offer and, in some cases, the non-fulfilment of the social rights of the arrested workers. It is intended, therefore, to improve the debate by bringing the social critique of labour to criminal execution.
