A dimensão do dano social causada por crises financeiras é, frequentemente, acompanhada de questionamentos acerca da responsabilização criminal de seus causadores. Considerando, entretanto, que qualquer tentativa de responsabilização está condicionada à identificação de um nexo causal entre ações concretas e os resultados socialmente danosos, o presente trabalho tem como objetivo identificar em que medida o sistema legal, como tecnologia de controle social, possui uma configuração adequada à operacionalização de tal finalidade. Para cumprir com tal objetivo, partimos do método retrodutivo, nos termos propostos pelo realismo crítico de Roy Bhaskar, procedendo a uma síntese das múltiplas determinações do processo da crise, a partir de diferentes elementos de teoria social substantiva, para identificar o nexo causal necessário. Após a identificação da natureza dessas relações causais, concluímos que, para que uma responsabilização adequada possa ser atingida, torna-se necessária a correção de vícios de origem localizados na tecnologia do direito, sobretudo em termos da superação de uma concepção de responsabilidade individual como categoria fundante da filosofia do direito penal.

The extent of social damage caused by financial crises is often accompanied by questions about the criminal liability of those who caused it. Considering, however, that any attempt at attributing responsibility is conditioned by the identification of a causal link between concrete actions and socially harmful results, this paper aims to identify to what extent the legal system, as a technology of social control, possesses a suitable configuration for the operationalization of this purpose. To accomplish this goal, we use the retroductive method, as proposed by Roy Bhaskar's critical realism, proceeding to a synthesis of the multiple determinations of the crisis process, based on different elements of substantive social theory, in order to identify the necessary causal link. After identifying the nature of these causal relations, we conclude that, in order for adequate manner of responsibility to be achieved, it becomes necessary to correct the original defects located in legal technology, especially in terms of overcoming a conception of individual responsibility as a founding category of the philosophy of criminal law.
