Apesar de a entrada em vigor da Lei n.? 10.792, de 2003, haver alterado substancialmente o regime jurídico das progressões de regime, afastando a obrigatoriedade da realização de exame criminológico, a jurisprudência fixou que a citada avaliação pode ser exigida, desde que mediante decisão judicial fundamentada. Apesar da consolidação de tal entendimento, são infindáveis as divergências quanto à valoração da perícia representada pelo exame criminológico para fins de progressão de regime e livramento condicional, notadamente em razão de tergiversações quanto ao escopo de cada uma das partes do laudo elaborado. A constatação do papel instrumental das avaliações no curso da execução, relativamente à individualização da pena se aplica ao exame criminológico para fins de apuração do requisito subjetivo à progressão de regime. A realização de pesquisa de campo demonstra a falta de critérios do Judiciário na valoração dos laudos periciais, contribuindo, à luz da revisão de literatura, ao estabelecimento de diretrizes à adequada valoração do exame criminológico para progressão de regime, consistentes fundamentalmente em métodos de apuração da satisfatoriedade da conduta do sentenciado no cumprimento da pena, de maneira a não incorrer em hipótese de Direito Penal do inimigo.

The 10,792 Act have substantially altered the progressive system in Brazil removing criminological examination requirements. But the criminological examination could be demanded by the judge. Although this question doesn't have any discussion, there are a lot of questions about the judicial evaluation regarding to the criminological examination due to the report's debate. The clinical exams during the prison are instruments of punishment individualization the same way as the criminological examination for the progressive system. The use of the trial method show the judges deficiency understanding and evaluating the criminological examination of progressive system. So the purpose of this study to find proper methods to understand and to evaluate of the criminological examination. In this way the judges aren't using the enemy law.
