A presente dissertação analisa como o instituto do erro no Direito Penal deve ser abordado quando incidente sobre a assessoriedade administrativa presente no tipo penal. Tendo em vista as mudanças que o Direito Penal vem sofrendo para se adequar à nova sociedade de risco em que se vive, os tipos penais passam a ser construídos de forma mais aberta, valendose com maior frequência de remissões normativas, dentre elas a assessoriedade administrativa. Isso posto, diferenciar-se-á esta das demais formas de remissão normativa para, assim, enfrentar como o erro sobre essa forma de remissão normativa deve ser tratado.

This dissertation analyzes error within criminal vagueness theory defined through subsidiarity. In view of the changes that Criminal Law has endured in order to adapt to the new society of risk, criminal vagueness theory is now built to be more open, using regulatory references more frequently, including subsidiarity. The dissertation will also distinguish subsidiarity from other forms of normative remission, in order to examine the particularities of error within this form of normative remission.
