O presente trabalho discorre sobre o controle de constitucionalidade formal da lei penal pela proporcionalidade a partir da análise crítica das teorias do direito versadas no cognitivismo ético e da problemática limitação do direito penal pelo direito constitucional. Ao tomar posicionamento na assunção da razão prática como método de aferição do sentido do direito penal, esta pesquisa parte da hipótese teórica da necessária releitura da proporcionalidade pela dogmática penal a qual, por sua vez, opera como o meio de integração da práxis penal na construção e interpretação do direito penal. Nesse sentido, a pesquisa confere os contornos teóricos para um controle de constitucionalidade formal da lei penal em dois níveis: o primeiro exige o cumprimento do princípio da legalidade mediante a estruturação do discurso jurídico por critérios racionais e o segundo demanda a análise da consideração e valoração pelo legislador penal das estruturas formais da proporcionalidade sob o enfoque penal.

This paper addresses the formal control of constitutionality of criminal law by proportionality from the critical analysis of the theories of law versed in ethical cognitivism and the problematic limitation of criminal law by constitutional law. By taking a stand on the assumption of practical reason as a method of understanding the meaning of criminal law, this research starts from the theoretical hypothesis of the necessary re-reading of proportionality by criminal dogmatics, which, in turn, operates as a means of integrating penal praxis in the construction and interpretation of criminal law. In this sense, the research provides the theoretical contours for a formal control of constitutionality of criminal law at two levels: the first requires compliance with the principle of legality by structuring the legal discourse by rational criteria and the second demands the analysis of the consideration and valuation by the criminal legislator of the formal structures of proportionality under the penal approach.
