Abstract in English
The present work is dedicated to the study of the possibility of choosing the applicable laws in plurilocalized contracts. It seeks to discuss the manifestation of party's autonomy through the choice of law that will govern the contract, as well as its impacts on conflicts of laws. In order to do so, we first define plurilocalized contracts, analyzing doctrinal criteria based on legal and economic theory, and the eclectic criterion adopted by the various legal systems due to the inefficiency of the first two. The chapter concludes with the definitions drawn directly from Conventions. Next, the autonomy and its reflections in other institutes of law are approached: public order and dépeçage. In the third chapter we try to deepen discussions about the conflicts of laws, with the help of the connection elements, renvoi and fraud against the law. Finally, we analyze the choice of applicable laws in Brazilian law and international sources.
