A partir da premissa de que apenas através da linguagem é possível expressar o Direito, esta tese se propõe a trazer reflexões para a redação e compreensão de instrumentos contratuais a partir do ponto de vista da linguagem e seu correspondente objetivo comunicacional. Primeiramente, como consequência de sua natureza textual, a pesquisa identifica o instrumento contratual como um ato comunicacional complexo. Esta conclusão permite mostrar os aspectos linguísticos que permeiam a redação e compreensão dos instrumentos contratuais, oferecendo um novo ponto de vista à matéria. Posteriormente, ancorada nos ensinamentos da Linguística Textual, a presente tese se dedica a identificar os elementos jurídicos que se relacionam com os princípios construtores de sentido de um texto, mais especificamente, um texto contratual. Tais princípios resultam em técnicas que, quando aplicadas, são capazes de reduzir o esforço cognitivo necessário para compreender o sentido do instrumento contratual por seus interlocutores. Desse modo, Direito e Linguística Textual se interconectam, trazendo uma abordagem interdisciplinar para os estudos dos contratos escritos.

Departing from the premise that only through language it is possible to express the Science of Law, this thesis aims to bring new reflections to the drafting and comprehension of contractual instruments from the point of view of language and its corresponding communicational purpose. First, as a result of its textual nature, the research identifies the contractual instrument as a complex communicational act. This conclusion allows us to demonstrate the linguistic aspects that are connected to the drafting and understanding of contractual instruments, offering a new point of view on the subject. Later, based on the studies from Text Linguistics, this thesis identifies the legal elements that relate to the principles of comprehension of a text, more specifically, a contractual text. Such principles can result in techniques that, when applied, can reduce the cognitive effort needed to understand the meaning of the contractual instrument by its readers. Thus, this thesis shows that Law and Text Linguistics are interconnect, bringing an interdisciplinary approach to the study of written contracts.
