O objetivo do autor desta tese é analisar a aplicabilidade das regras do sistema multilateral de comércio aos organismos produtores de padrões privados. Mais especificamente, o foco do autor é avaliar as possibilidades jurídicas e ideacionais para aplicação de normas do sistema multilateral de comércio a entidades e práticas de origem privada, as quais, potencialmente, erigem barreiras ou adicionam custos ao comércio internacional, de maneira supostamente inconsistente com as disposições dos acordos comerciais vigentes. Nessa análise, além da reconstrução histórica do sistema de comércio internacional e da análise diacrônica dos padrões privados, serão importantes os conceitos utilizados pela teoria construtivista das relações internacionais, que destacam a importância de aspectos imateriais na compreensão da dinâmica internacional. A hipótese subjacente à tese é a de que elementos jurídicos e ideacionais restringem a aplicação das regras do sistema multilateral de comércio aos padrões privados.

The purpose of the author of this thesis is to scrutinize the applicability of the rules of the multilateral trading system to private standards bodies. More specifically, the author's focus is to evaluate the legal and ideational possibilities for applying multilateral trading system rules to entities and practices of private origin, which potentially create barriers or add costs to international trade, in a way inconsistent with the provisions of existing agreements. In this analysis, in addition to the historical reconstruction of the international trading system and the diachronic analysis of private standards, the concepts used by the constructivist theory of international relations, which highlight the importance of immaterial aspects in understanding international dynamics, will be important. The hypothesis underlying the thesis is that legal and ideational elements restrict the application of the rules of the multilateral trading system to private standards.
