O objetivo deste trabalho é verificar o estado atual da doutrina e da jurisprudência do Direito Internacional Privado, relativas ao reconhecimento das situações jurídicas estrangeiras para determinar se se faz necessária a criação de um novo método do Direito Internacional Privado ou se, ao contrário, o método conflitual clássico, tal como criado por Savigny, acrescido das inovações, consubstanciadas em novos instrumentos ou ferramentas, como as exceções de proximidade, fruto do estudo do princípio da proximidade, ou a exceção de previsibilidade, tirada da legítima expectativa das partes, é capaz de garantir o reconhecimento de tais situações, sobretudo no que concerne o estatuto pessoal.

The objective of this work is to verify the current state of the doctrine and jurisprudence of Private International Law, related to the recognition of foreign legal situations, to determine if it is necessary to create a new method of Private International Law or if, on the contrary, the method classic conflictual, as created by Savigny, added to the innovations, embodied in new instruments or tools, such as the exceptions of proximity, fruit of the study of the principle of proximity, or the exception of predictability, drawn from the legitimate expectation of the parties, is capable of ensure the recognition of such situations, especially with regard to personal status.
