O presente trabalho tem como objetivo compreender as propostas brasileiras e chinesas para o setor portuário. Essa investigação se justifica pela necessidade urgente de modernização do setor portuário no Brasil e de definição de um modelo que responda efetivamente às necessidades do país. Esse trabalho parte do pressuposto de que a China tem hoje um modelo portuário único, trabalha-se com a hipótese de que elementos desse modelo poderiam ser assimilados pelo Brasil, o que impõe um novo tratamento normativo. Este trabalho tem como base a revisão da literatura especializada do Direito Portuário que compara os diversos modelos existentes, sobretudo, as definições propostas pelo Banco Mundial. Para melhor entender a singularidade do modelo chinês, far-se-á recurso à metodologia do Direito Comparado, assim como ao método analítico. Espera-se, como resultado dessa pesquisa, que tem enorme potencial de aplicação concreta, compreender de que modo o sistema brasileiro, que já recebe investimentos chineses, pode ser impactado pela influência do modelo chinês e quais as consequências dessa interação, assim como refletir sobre a conveniência e adequação da possível adoção de elementos desse modelo em nossa realidade.

The present work aims to understand the Brazilian and Chinese proposals for the port sector. This investigation is justified by the urgent need to modernize the port sector in Brazil and to define a model that effectively responds to the country's needs. This work is based on the assumption that China currently has a unique port model, working with the hypothesis that elements of this model could be assimilated by Brazil, which imposes a new normative treatment. This work is based on a review of the specialized literature on Port Law that compares the different existing models, above all, the definitions proposed by the World Bank. To better understand the uniqueness of the Chinese model, the Comparative Law methodology will be used, as well as the analytical method. It is expected, as a result of this research, which has enormous potential for concrete application, to understand how the Brazilian system, which already receives Chinese investments, can be impacted by the influence of the Chinese model and the consequences of this interaction, as well as to reflect on the convenience and adequacy of the possible adoption of elements of this model in our reality.
