O   presente   trabalho   aborda   a   proteção   jurídica   dos   trabalhadores   indocumentados  no  Brasil.  De   início,  trata  da  dinâmica  do  movimento  migratório   para  o  país  no  período  entre  2012  e  meados  de  2017  e  as  possíveis  teorias  para   explicar  esse  fenômeno.  Em  seguida,  trata  da  evolução  da  condição  jurídica  dos   migrantes   no   Direito   Internacional   e   discorre   sobre   os   direitos   substantivos   e   processuais  para  garantir  a  tutela  desses  sujeitos  de  direito  nos  sistemas  global   (ONU  e  OIT)  e  interamericano,  além  de  analisar  a  legislação  nacional  de  proteção   dos   migrantes,   inclusive   a   Lei   13.445/2017.   Terceiro,   estuda   a   hierarquia   e   a   sindicabilidade  dos  tratados  de  proteção   jurídica  dos  migrantes  no  ordenamento   pátrio.   Por   fim,   discorre   sobre   o   mecanismo   do   sistema   interamericano   para   apurar   violação   de   direitos   fundamentais   trabalhistas   dos   indocumentados   no   Brasil

This work   deals with   the   legal protection   of   undocumented   workers   in   Brazil.   Firstly,   it   studies   the   dynamic   of   migratory   movement   towards   the   country   from   2012   until   mid-­2017.   Secondly,   it   analyzes   the   history   of   the   legal   status   of   immigrants   under   international   law,   and   identifies   substantive   and   procedural   elements   of   law   required   to   assure   the   protection   of   every   migrant   not   only   in   global  (United  Nations  and  International  Labour  Organisation)  and  Inter-­American   systems,  but  also  in  Brazil's  national  legal  system,  including  under  Law  13.445  of   24   May   2017.   Thirdly,   it   scrutinizes   the   hierarchy   and   applicability   of   treaties   protecting   migrants'   rights.   Finally,   it   analyses   how   the   mechanism   of   interAmerican   protection   of   human   rights   works   in   order   to   determine   violations   in   Brazil
