A presente tese tem por objetivo realizar uma análise paradigmática da propriedade intelectual, conferindo ênfase tanto aos elementos que formam aquilo que denominaremos como sendo o paradigma internacional da propriedade intelectual, quanto aos aspectos que formam suas crises, analisadas sob diferentes perspectivas. Trata-se, em outras palavras, de uma análise problematizada da teoria da propriedade intelectual, a partir de recortes históricos e conjunturais que permitem, argumenta-se, o exercício de reflexão acerca da formação de um paradigma internacional que a acompanha, paradigma esse formado por fundamentos e estruturas que, apesar de seu cariz multifacetado, se reproduzem de forma contínua no tempo, desde a prensa de tipos móveis até os modernos sistemas de comunicação. Busca-se, dessa forma, explorar uma base conceitual que enalteça a construção contínua do instituto, seja como forma de compreender as dinâmicas do passado, mas, mais importante, como maneira de trazer luz, a partir delas, às controvérsias que se manifestam no tempo presente. Esse desiderato é também (e principalmente) atingido na presente tese por meio da análise do conjunto de elementos que formam as crises da matéria, crises essas analisadas sob quatro perspectivas diferentes: a) tecnológica; b) de autoria; c) econômica; e d) político-jurídica. Levando-se em consideração, assim, o caráter realmente multidisciplinar da matéria, a parte que tratará das crises buscará analisar os meandros das quatro dimensões de crise escolhidas para fortalecer a noção do paradigma, explorando o argumento de que elas têm o condão de explicar a propriedade intelectual com maior acuracidade do que, propriamente, os próprios institutos jurídicos que definem a sua normatização (que representam, ao fim e ao cabo, tanto o local onde toda a problemática deságua, quanto mais uma das dimensões de crise). O exame do paradigma internacional, assim como o das crises, além de viabilizar os estudos ínsitos que ecoam em ambos, também oferecerá, de quebra, elementos fundamentais para que se possa refletir sobre os formatos possíveis da propriedade intelectual, ou seja, acerca do seu futuro, viabilizando com isso a prospecção de determinados caminhos que podem definir a matéria, ao menos, no horizonte visível

The present thesis has as its objective to perform a paradigmatic analysis of intellectual property, emphasizing both the elements that form what we define as the international intellectual property paradigm, and the aspects that form its crises, analysed under different perspectives. In other words, it is with regard to a problematized analysis of the intellectual property theory, based on historical and circumstantial aspects that enable a reflective exercise on the formation of an international paradigm accompanying it. This paradigm is formed by fundamentals and structures that, despite its multi-faceted nature, reproduce themselves in a continuous way through time, since the print press up to modern communication systems. In this sense, it seeks to explore a conceptual basis that praises the continuous construction of the institute, as a way to comprehend past dynamics, but, most importantly, as a manner of bringing light to the controversies which is manifested in present time. This desideratum is also reached (and mainly) in the present thesis through the analysis of the group of elements that form the subject of crises, analysed under four different perspectives: a) technological; b) authorial; c) economic; and d) political-juridical. Therefore, taking the really multidisciplinary character of the subject into consideration, the part which addresses the crises will seek to analyse the meanders of the four crisis dimensions chosen to strengthen the notion of paradigm, exploiting the argument that they have the wandering of explaining intellectual property with more accuracy than the own juridical institutions which define its standardization (that represent, in the end, where the whole issue drains as well as one more dimension of the crisis). The exam of the international paradigm, as well as the crises one, in spite of enabling the characteristic studies that echo in both of them, will also offer fundamental elements so that reflection can exist on possible formats for intellectual property, therefore, regarding its future, enabling the prospection of certain paths that can define the subject, at least in the foreseeable future
