A presente dissertação de mestrado tem por tema o reconhecimento de situações jurídicas interculturais no direito internacional privado, valendo-se para estudo de caso da questão das famílias LGBTQIA+, constituídas em estado que permita esse arranjo jurídico, que possuem elemento de internacionalidade com estado de matriz islâmica e que, portanto, vale-se do direito religioso do Islam para o campo familiarista. No que concerna à metodologia, vinculamo-nos ao paradigma epistemológico da crítica-dialética, manejando as técnicas de pesquisa bibliográfico documental e empírica qualitativa. O primeiro capítulo enceta retrospectiva histórica acerca do reconhecimento, ainda no termo dos direitos adquiridos. O segundo se debruça sobre o tratamento e proteção dados pelo direito internacional público e direito internacional privado à diversidade de orientações sexuais, identidades e expressões de gênero (LGBTQIA+). Por seu turno, o mais amplo é o terceiro capítulo que analisa os desafios de direito internacional privado ao reconhecimento das famílias LGBTQIA+ pelo direito islâmico, sendo desafios técnico-jurídicos e meta-técnicos jurídicos, além de albergar as propostas de superação deles, no campo do direito internacional privado pela pluralidade de métodos e no dos direitos humanos pelos diálogos transculturais e interpretação internacional dos direitos humanos. O derradeiro quarto capítulo analisa questões centrais de direito islâmico (Sharia) e a teologia do Islam Inclusivo para fundamento correlato do reconhecimento. Ademais, ainda no quarto capítulo se encontram os resultados da pesquisa empírica qualitativa, realizada com pessoas cis hétero e LGBTQIA+ muçulmanas, assim como líder religioso islâmico (Sheik) em atividade no Brasil. Por fim, percebemos que há viabilidade no reconhecimento dos direitos familiares em tela dada a confluência dos métodos do direito internacional privado com a reestruturação de valores muçulmanos através de debates internos aos fiéis e externos com as experiências de direitos humanos internacionais. A conclusão, assim, resta na instituição da ijtihad islâmica como elemento já em voga para esta tarefa de transposição cultural, sendo o caminho próprio do Islam para os diálogos propostos e comunicação de valores de direitos humanos buscada.

This master's dissertation has as its theme the recognition of intercultural legal situations in private international law, making use of a case study on the issue of LGBTQIA + families constituted in a state that allows this legal arrangement which have an element of internationality with an Islamic state that, therefore, Islamic Law for the family field. Regarding methodology, we are linked to the critical-dialectic epistemological paradigm, handling the techniques of documentary- bibliographic and qualitative empirical research. The first chapter introduces a historical retrospective on the recognition institute, still as acquired rights. The second focuses on the treatment and protection given by public international law and private international law to the diversity of sexual orientations, identities, and gender expressions (LGBTQIA +). The broadest is the third chapter that analyzes the challenges of private international law to the recognition of LGBTQIA + families in Islamic law, being technical-legal and meta-technical-legal challenges, in addition to hosting proposals to overcome them: in the field private international law the plurality of methods and in the field of human rights cross-cultural dialogues and international interpretation of human rights. The fourth chapter analyzes central issues of Islamic law (Shari'a) and the theology of Inclusive Islam for yet another foundation of recognition. Furthermore, the fourth chapter also contains the results of qualitative empirical research, carried out with straight cis and LGBTQIA + Muslim people, as well as an Islamic religious leader (Sheik) working in Brazil. Finally, we realize that there is feasibility in recognizing family rights of those families given the confluence of the methods of private international law with the restructuring of Muslim values through internal debates of the faithful and external ones with the experiences of international human rights. The conclusion, therefore, remains in the institution of Islamic ijtihad as an element already in vogue for this task of cultural transposition, being the proper path in Islam for the proposed dialogues and communication of human rights values.
