Busca-se com o presente trabalho analisar o tratamento dispensado pelo Estado brasileiro às recomendações proferidas pela Comissão Interamericana de Direitos Humanos, a partir do Caso Margarida Maria Alves e Familiares (Caso 12.332). A investigação se justifica tendo vista o impacto transformador dos sistemas de proteção aos direitos humanos que foram concebidos no pós-II Guerra Mundial no âmbito global o sistema onusiano e regional os sistemas europeu, africano e interamericano , os quais possuem respectivos arcabouços normativos e instituições de promoção, monitoramento e garantia de direitos humanos. Especificamente quanto ao sistema interamericano, estudado em detalhes neste trabalho, destacam-se a Comissão Interamericana de Direitos Humanos e a Corte Interamericana de Direitos Humanos como órgãos principais. A Comissão Interamericana é o órgão que possui abrangência continental e sua função primordial é promover a observância e a defesa dos direitos humanos. Nesse cenário, o Brasil configura-se como um líder regional, ator presente no sistema interamericano e demandado perante a Comissão. Torna-se, assim, relevante avaliar em que medida o Estado brasileiro implementa as recomendações proferidas pela Comissão no sistema de petições de sua competência. O estudo do Caso 12.332 foi a linha condutora da pesquisa, que propiciou concluir pela efetividade mitigada das recomendações da Comissão Interamericana no Brasil.

This monograph is centered on the analysis of the treatment given by Brazil to the recommendations issued by the Inter-American Commission on Human Rights, based on the study of the Margarida Maria Alves and Family case (Case 12.332). This investigation is justified in view of the transformative impact of the human rights protection systems that were conceived in the post-World War II period, both globally and in the different regions that today have a normative framework and institutions for the promotion, monitoring and guarantee of human rights, as it is the case of Europe, America and Africa. In the American continent, specifically, the Inter-American system of protection of human rights has prospered, and it will be studied in detail. The Inter-American Commission on Human Rights and the Inter-American Court of Human Rights are the main bodies of this regional system. The Inter-American Commission is a key component of the Organization of American States, whose mission is to promote and protect human rights in the American hemisphere. Brazil is a regional leader, an active player in the Inter-American system and a defendant before the Commission. Therefore, it becomes relevant to assess the extent to which Brazil implements the recommendations issued by the Commission within its individual petition system. The case study was the guiding line of the research, which led to the conclusion of the partial effectiveness of the Commissions recommendations in Brazil.
