A circulação internacional de bens culturais é um fenômeno ancestral. Ao longo dos séculos, observou-se um intenso fluxo de artefatos, objetos etnográficos, obras de arte, dentre outros bens móveis de valor cultural ao redor do mundo. A partir dos movimentos de independência e descolonização, no século XX, aumentaram significativamente os pedidos de repatriação por parte dos países de origem, não obstante a forte resistência dos atuais detentores em efetivamente proceder ao retorno ou à restituição de bens culturais. Tendo em vista tal contexto, o presente trabalho teve por objetivos compreender historicamente esse duplo trânsito, de expatriação e repatriação de bens culturais; analisar criticamente os instrumentos de Direito Internacional vigentes que dispõem sobre os mecanismos de restituição e retorno; e verificar a necessidade de se reconhecer nova extensão a tais mecanismos, consoante às demandas atuais, buscando esboçar quais fundamentos justificariam tal extensão e quais os desafios práticos para assegurar sua viabilidade. Para tanto, a metodologia adotada conjugou uma abordagem fenomenológica a uma análise sociológica crítica, visando a apreciar tais questões a partir das tensões geopolíticas, históricas e culturais existentes entre os países de origem e os países que concentram as maiores coleções de bens culturais. A pesquisa realizada desenvolveu-se sob o viés de um arcabouço teórico crítico que defende uma perspectiva transcivilizacional do Direito Internacional e das relações internacionais, em direção à mitigação das assimetrias de poder entre as nações. A análise demonstrou a emersão de uma nova moralidade em torno da detenção, da gestão e da circulação dos bens culturais, a qual impõe adotar novas práticas de diligência ética e desconstruir alguns dos pressupostos que ditavam o cerne dos instrumentos de Direito Internacional mobilizados nos casos de repatriação. Observou-se, por fim, que esse novo padrão moral deve orientar as iniciativas concretas de restituição e retorno, tanto no âmbito de sua formalização, quanto de sua efetivação prática.

The international circulation of cultural objects is an ancestral phenomenon. Throughout the centuries, an intense flow of artifacts, ethnographic objects, works of art, among other moveable property of cultural value, has been observed around the world. As of the independence and decolonization movements, in the twentieth century, repatriation requests by source countries have significantly increased, notwithstanding the strong resistance by the current possessors in effectively returning or restituting cultural objects. In view of that context, the present essay intended to historically understand that double transit, of cultural objects expatriation and repatriation; to critically assess International Laws instruments in force which set provisions on the mechanisms of restitution and return; and to verify the need of recognizing a new extension to such mechanisms, in accordance with current demands, seeking to draft which fundaments justify such extension and what are the practical challenges for ensuring its feasibility. For that purpose, the adopted methodology combined a phenomenological approach with a critic-sociological analysis, pursuing an assessment of those issues from the standpoint of geopolitical, historical, and cultural tensions existing between source countries and the countries which currently concentrate the largest cultural objects collections. Research has been developed under the bias of a critical theoretical framework that defends a transcivilizational perspective of International Law and of international relations, towards the mitigation of power asymmetries between nations. The analysis has demonstrated the emergence of a new morality in regard to possession, management, and circulation of cultural objects, which requires adopting new practices of ethical diligence and deconstructing some of the assumptions that dictated the core of International Laws instruments applicable to repatriation affairs. At last, it has been observed that this new moral standard shall guide concrete initiatives on restitution and return, both in terms of their formalization and of their practical implementation.
