O Sistema Interamericano de Direitos Humanos é utilizado de forma estratégica por movimentos de mulheres para dar visibilidade às desigualdades estruturais e para pressionar Estados a promover mudanças sociais. Apesar do descaso com a temática de gênero em seus primeiros anos de atuação, a Corte Interamericana de Direitos Humanos tem sido protagonista no desenvolvimento de parâmetros internacionais de proteção dos direitos das mulheres. A incorporação da interseccionalidade foi considerada uma possibilidade de superar as lacunas de normativas e de decisões internacionais que apenas favoreciam a mulheres em posição de privilégio dentro do grupo minoritário. Em 2015, no caso Gonzales Lluy e outros Vs. Equador, a Corte reconheceu a categoria jurídica da discriminação interseccional. Assim, o objetivo principal deste trabalho é construir reflexões críticas sobre as sentenças da Corte acerca dos direitos das mulheres, a partir da interseccionalidade como uma ferramenta analítica, a fim de revelar dinâmicas ocultas que obstam o reconhecimento de direitos e a propositura de reparações às mulheres posicionadas no entrecruzamento de diversos sistemas estruturais de discriminação. A dissertação conclui que a incorporação da interseccionalidade pela Corte Interamericana é um processo em andamento, marcado por contradições e incoerências, pois nem sempre reflete as premissas teóricas do conceito. Há, ainda, uma predominância da categoria gênero para identificar violações de direitos que afetam mulheres, silenciando a maneira como o racismo e as opressões econômicas estruturam as experiências de mulheres subalternizadas de forma específica. Por outro lado, há potencialidades, a exemplo da maior abertura para justiciabilidade de direitos econômicos, sociais e culturais.

Womens movements have strategically accessed the Inter-American Human Rights System to expose structural inequalities and to pressure States to promote social change. Despite the indifference regarding gender in its first years of judicial practice, the Inter-American Human Rights Court has become a protagonist in the development of international standards for the protection of women's rights. The incorporation of intersectionality has been considered an opportunity to overcome the gaps in international law and decisions that only favors women in a position of privilege within the minority group. In 2015, in the case of Gonzales Lluy and others Vs. Ecuador, the Court recognized the legal category of intersectional discrimination. Thus, the main objective of this work is to provide critical reflections by using intersectionality as an analytical tool to reveal hidden dynamics that impair the recognition of womens rights and the proposition of reparations to women positioned at the intersection of several structural systems of discrimination. The dissertation concludes that the incorporation of intersectionality by the Inter-American Court is an ongoing process, defined by contradictions and inconsistencies, since not always reflect the theoretical premises of the concept. There is also found a predominance of the gender category to identify womens rights violations, silencing the way racism and economic oppression structure the experiences of marginalized women in a specific way. On the other hand, there are potentialities, for example, the greater openness to the justiciability of economic, social and cultural rights.
