A presente dissertação constitui estudo jurídico de direito comparado da legislação, da doutrina e da jurisprudência sobre controle de concentrações econômicas do Brasil, França e México; bem como, subsidiariamente, do MERCOSUL, da União Europeia e do NAFTA, blocos econômicos a que, respectivamente, pertencem os três Estados citados. Embora trate-se de estudo jurídico, são inevitáveis referências colaterais à ciência econômica, visto que o direito econômico, ramo jurídico em que se integra o direito concorrencial, possui estrutura jurídica, mas grande parte de seus conceitos são econômicos. Fez-se micro comparação sincrônica, consoante os métodos de direito comparado, dos aspectos acima, entre países pertencentes à família romanística ou romano-germânica e organizações internacionais intergovernamentais de integração econômica, também chamadas blocos econômicos, que possuem entre seus membros países vinculados, tradicionalmente, à commom law. De início, aquilata-se semelhanças e diferenças. Após estudar, inicialmente, as origens e o desenvolvimento do direito concorrencial, com ênfase na concentração econômica, dedica-se o trabalho à perquirição dessa matéria em cada um dos países, bem como ao exame da questão no âmbito do bloco econômico a que pertencem. A seguir é feita a comparação, tanto entre os Estados, quanto entre os blocos econômicos. Como o direito comparado possui, além dos intuitos comparatísticos, uma meta teleológica, são, ao final traçadas conclusões sobre a adequação da legislação brasileira vigente sobre concentrações, bem como feitas sugestões de mudança.

This dissertation is a study within the field of Comparative Law, consisting of legislation, doctrine, and jurisprudence on the control of economic concentration in Brazil, France, and Mexico; in addition, MERCOSUR, as well as the European Union and NAFTA, the economic trade blocs in which the three respective sovereign nations mentioned belong. Although this is a legal study, collateral references to Economic Science are parallel in nature, since Economic Law, a legal branch of study in which Competition Law is integrated, has its own structure in the field of Law; however, most of its concepts have an economic basis. Simultaneous micro-comparison, according to the methods of Comparative Law within the aspects above, between countries belonging to Roman or Roman-Germanic familiar entities, as well as international and intergovernmental economic integration organizations, are also referred to as economic trade blocs. Amongst the members of these respective blocs, there are traditional countries bound under common law. At first, one notices both the similarities and the differences. Whereupon one studies the initial origins and development of Competition Law, with an emphasis on economic concentration, research must be devoted to this matter of study under each individual sovereignty, as well as the examination of issues arising within the economic trade bloc to which they respectively belong. The following work is to be treated as a comparison, both between the sovereign nations and between the economic trade blocs. As Comparative Law study dictates, aside from its natural comparative purposes, that there is also a teleogical purpose, whereupon final conclusions are drawn, prioritizing the adequacy of Brazilian legislation regarding economic concentration, as well as suggestions for change.
