O presente estudo visa a examinar a relação estabelecida entre o Direito Internacional e o Direito Interno na proteção de Direitos Sociais no Brasil, a partir da influência da Organização das Nações Unidas. No primeiro capítulo faz-se uma relação entre a afirmação histórica das Organizações Internacionais em paralelo com a afirmação histórica dos Direitos Humanos, com destaque para a atuação da Organização das Nações Unidas nesse processo. No segundo capítulo aborda-se a mudança no enfoque do Direito Constitucional a partir da Constituição Federal de 1988, que proporcionou a abertura do Estado brasileiro às relações internacionais, especialmente no contexto do neoconstitucionalismo. Finalmente, o terceiro capítulo se debruça sobre a mudança de perspectivas na relação entre o Direito Internacional e o Direito Interno e a adoção de legislações brasileiras voltadas à proteção de Direitos Sociais. Buscou-se demonstrar, assim, que a partir de uma relação que se estabelece entre o Direito Internacional e o Direito Interno, o processo legislativo deste acaba sendo influenciado diretamente por aquele em virtude da globalização e da pluralização das fontes do Direito Internacional, que passam a ser reproduzidas no âmbito doméstico, de maneira transnormativa, como se Direito Interno fossem, muito embora possuam o Direito Internacional em sua gênese.

This study aims to examine the relation between International Law and Domestic Law on the protection of Social Rights in Brazil, under the influence of the United Nations and of Brazil's 1988 Constitution. This inquiry is divided in three chapters. The first chapter analyses the historical building and international recognition of human rights, besides the appearance of International Organizations, such as - and mainly - the United Nations. In the second chapter, it crosses out the cooperative philosophy of UN's purposes, in the context of constitutional changes - for example, those arisen from Brazil's Constitution of 1988, in the domestic law, under neoconstitutional ideas. Finally, in the third chapter, it highlights the changing relation between International and Domestic law and its consequence on the adoption of Brazil's legal framework of Social Rights protection. At this time, this research tried to demonstrate that, coming up from a transnational and transnormative approach, Brazil's law making process if influenced by the United Nations standards. So, the domestic law, despite of being nation on its form, is international on its genesis.
