Reenvio e convergência do direito aplicável. O direito internacional privado se ocupa, entre outros objetos, de resolver o concurso de leis no espaço, entretanto não se limita a tal fim. Estabelecer o conteúdo da referência do direito internacional privado de um Estado a um ordenamento jurídico estrangeiro é necessário. A referência pode ser material ou englobar também as normas de conflito do Estado estrangeiro. O instituto do reenvio advém de tal questão. Visa-se a determinar se o reenvio é um princípio de direito internacional privado e, em caso negativo, quando deve ser chamado a atuar. A convergência do direito aplicável é almejada pelo direito internacional privado, pois traz consigo potencial harmonia de julgados, facilitando o reconhecimento de sentenças estrangeiras e tornando menos relevante, senão irrelevante, a escolha do foro. O reenvio pode ser uma técnica de direito internacional privado para viabilizar a convergência do direito aplicável onde, em princípio não ocorreria. São analisadas legislações nacionais sobre o assunto, bem como o modo pelo qual o reenvio tem sido tratado nas recentes fontes convencionais. Faz-se uma proposta de legislação ao Brasil em relação à regulação do reenvio.

Renvoi and convergence of the applicable law. Private international law studies, among other subjects, the conflit of laws in space, however it does not limitate itself to such subject. It is necessary to establish the content of the reference made by the private international law of a country to a foreign legal system. The reference might be only material or it can also cover the private international law of the foreign country. The renvoi emerges from such thinking. One intends to determine if the renvoi is a principle of the private international law and, if negative, when the renvoi should apply. The private international law desires the convergence of the applicable law because it carries with itself the potencial harmony of decisions, making it easier for foreign decisions to by recognized within a different country and making less relevant, maybe even irrelevant, the choice of forum. Renvoi can be a private international law technique to make feasible the converge of the applicable law when it would not occur originally. We analyze several local legislations on the matter as the means by which the renvoi has been regulated by the late non-national sources of private international law. We make a proposition of bill of law to Brazil regarding regulation of renvoi.
