Ao analisar o cumprimento da Convenção da Haia sobre os Aspectos Civis do Sequestro Internacional de Crianças pelo Estado Brasileiro, em virtude da forma com a qual houve a sua implementação internamente, dando por competente para o julgamento dos casos a Justiça Federal, é possível constatar a existência de entraves que prejudicam o alcance dos objetivos do tratado, como celeridade, eficiência e o escopo de se evitar a criação de um título jurídico ilegítimo. Vê-se que as regras de competência do processo interno podem influenciar o cumprimento de acordos internacionais. Imperioso se faz o comprometimento do Estado como um todo com a Convenção, desenvolvendo novos instrumentos jurídicos e inserindo a Justiça Estadual no contexto do direito internacional, para criação de um Estado mais atento às necessidades de um mundo inserido na pós-modernidade

In analyzing compliance with the Hague Convention on the Civil Aspects of International Child Abduction by the Brazilian State, due to the way in which it was implemented internally, by giving the Federal Court as competent for the trial of cases, it is possible to verify the obstacles to the achievement of the objectives of the treaty, such as speed, efficiency and the scope of avoiding the creation of an illegitimate legal title. It is seen that the rules of competence of the domestic process can influence the fulfillment of international agreements. It is imperative to commit the State as a whole to the Convention, developing new legal instruments and inserting States Courts in the context of international law, in order to create a State that is more attentive to the needs of a world inserted in postmodernity
