O foco da presente dissertação é ponderar sobre a proporcionalidade da expulsão enquanto resposta estatal à conduta criminosa de estrangeiros. Analisou-se a medida administrativa sobre a ótica da teoria dos direitos fundamentais de Robert Alexy, especificamente no que concerne as três etapas do teste de proporcionalidade: adequação, necessidade e proporcionalidade em sentido estrito. Assim, estudou-se tanto a coerência jurídica como a eficiência da medida de expulsão para alcançar seus fins propostos. Para efeito de contextualização, o dispositivo legal em vigor (art. 54 e seguintes da Lei n° 13.445 de 2017, conhecida como Lei de Migração) foi comparado suas versões anteriores. Tanto a prevista no Estatuto do Estrangeiro (art. 65 e seguintes da Lei n° 6.815 de 1980) como as demais normas historicamente aplicadas para promover expulsões. Concluiu-se que a expulsão de estrangeiro em vigor, conforme prevista na Lei de Migração, desviou-se do raciocínio jurídico que justificava a existência de suas versões anteriores, de maneira que está mais próxima de ser uma consequência jurídica acessória de uma condenação penal, que uma medida administrativa.

The focus of this dissertation is to analyze the proportionality of deporting as a state response to the criminal conduct of foreigners. The administrative measure was studied through the perspective of Robert Alexy's theory of fundamental rights, specifically regarding the three steps of the proportionality test: adequacy, necessity and proportionality in the strict sense. Thus, both legal coherence and the efficiency of the expulsion measure to achieve its proposed ends were studied. In order to contextualize the analyses of the legal provision in force (art. 54 et seq. Of Law No. 13,445 of 2017, known as the Migration Law), it was compared to its previous versions. Both the provisions of the "Estatuto do Estrangeiro" (art. 65 et seq. from Law n° 6.815, of 1980) and the other provisions historically applied to promote expulsions. It was concluded that the deportation due to criminal conviction, as provided for in the Migration Law, deviates from the legal reasoning that justified its previous versions, so that it is closer to being an accessory legal consequence of a criminal conviction than an administrative measure.
