Partindo da noção contemporânea de direito internacional, que encontra nos direitos humanos o seu fator estruturante, o presente trabalho investiga o impacto do sistema jurídico internacional de proteção aos direitos humanos no sistema jurídico internacional de proteção aos investimentos, tomando como objeto de estudo a arbitragem de investimento. Assim, após explanar esses dois sistemas normativos, bem como suas origens e acepções contemporâneas, apresenta-se, a partir das óticas dos principais sujeitos da arbitragem de investimento, quais sejam os investidores, os Estados, a sociedade civil na condição de amicus curiae e o próprio tribunal arbitral, de que formas as questões e os argumentos que tangenciam, direta ou indiretamente, o arcabouço normativo de proteção aos direitos humanos passaram a ser suscitadas no âmbito daquele mecanismo de solução de disputas. Em seguida, traz-se ao debate alguns casos emblemáticos em que tribunais arbitrais foram suscitados a enfrentar ou analisar questões típicas de direitos humanos para solucionar as lides apresentadas nas arbitragens de investimento. Por fim, ante as dificuldades experimentadas pelos tribunais arbitrais de investimento relativas à sua falta de juridição para aplicação de normas que não estejam contempladas nos tratados de investimento demonstra-se ser necessário, tal como vem acontecendo de forma ainda bastante incipiente, que o sistema jurídico internacional de proteção aos investimentos passe pelo processo de humanização a ser refletido nos tratados de investimento.

Departing from the fact that the contemporary notion of international law finds in human rights its structuring factor, the present paper investigates the impact of the international human rights in the international legal system for protection of investments. In order to do so, after briefly explaining these two normative systems, its origins and its contemporary concepts, it is presented, throughout the study of the investment arbitration system, how the normative framework for protection of human rights is being raised within the scope of such dispute settlement mechanism. Such analysis is made from the lenses of the main players in the investment arbitration, namely, the investor, the State, the civil society acting as amicus curiae and the arbitrators themselves. Afterwards, its is presented some relevant case law in which investment arbitral tribunals were inquired on deciding on the applicability of international human rights norms. Finally, in view of the difficulties faced by some investment arbitral tribunals regarding their lack of jurisdiction for the application of rules that are not covered by investment treaties, this paper demonstrates that it is absolutely necessary that the international law humanization process is reflected in the international investment protection legal system, as it is already being verified in a very inceptive way in some investment treaties.
