As controvérsias que permeiam o terceiro setor lhe são inerentes. Desde a imprecisão terminológica até a classificação das chamadas entidades paraestatatais, é possível identificar, com certa frequência, entendimentos diagonalmente divergentes. No Brasil, a despeito do terceiro setor atuar amplamente há muito tempo, o tema ganhou maior relevância nos últimos 20 (vinte) anos, e evoluiu à luz das reformas administrativas implementadas neste período. Desse modo, o Plano Diretor de Reforma do Aparelho do Estado - que buscou maior gerencialismo na Administração Pública - criou alicerce para surgimento de uma nova onda do terceiro setor, fundamentada na transferência de serviços públicos não exclusivos às chamadas entidades paraestatais. Ainda mais recentemente, por razões várias, como o obscuro contexto normativo então vigente e os muitos escândalos que acometeram o terceiro setor, mostrou-se necessária a edição de um novo diploma, que bem sistematizasse e regulasse as parcerias estabelecidas entre a Administração Pública e as entidades paraestatais. Adveio, neste sentido, a Lei nº 13.019/2014, notoriamente conhecida como o Marco Regulatório das Organizações da Sociedade Civil, que visa consolidar todo o regramento jurídico do tema. Eis a nova, e atual, onda de transformações do terceiro setor. O presente trabalho tem como objetivo, neste sentido, analisar detidamente os principais institutos do Marco Regulatório, comparando-os sistematicamente com o ordenamento jurídico vigente antes do advento da Lei nº 13.019/2014. Além disso, considerando-se as muitas inovações legislativas, buscou-se, junto às ora organizações da sociedade civil, os impactos práticos desse novo marco que tem como escopo central preparar todos os atores envolvidos para o futuro e para as novas ondas de transformação do terceiro setor.

The controversies that permeate the third sector are inherent to it. From terminological inaccuracy to the classification of so-called para-state entities, it is possible to identify, with some frequency, divergent understandings. In Brazil, despite the fact that the third sector has been acting for a long time, the theme has gained more relevance in the last twenty (20) years and has evolved in light of the administrative reforms implemented during this period. Thus, the State Apparatus Reform Master Plan, from 1995 - which sought greater managerialism in Public Administration - laid the foundation for the emergence of a new wave of the third sector, based on the transfer of non-exclusive public services to the so-called parastatal entities. Even more recently, for many reasons, such as the obscure normative context then in force and many scandals that affected the third sector, it was necessary to issue a new diploma that pretends to systematize and regulate the partnerships established between the Public Administration and the parastatal entities. In this sense, Law No. 13.019 / 2014, famously known as the Regulatory Framework of Civil Society Organizations, was adopted, which aims to consolidate the entire legal regulation of the subject. This is the new and current wave of transformations in the third sector. In this sense, this paper aims to carefully analyze the main institutes of the Regulatory Framework, systematically comparing them with the legal system in force before the advent of Law No. 13.019 / 2014. In addition, considering the numerous legislative innovations, the practical impacts of the new civil society organizations were sought at present by the civil society organizations, whose central scope is to prepare all actors involved for the future and the new waves of transformation of the third sector.
