A presente tese tem por finalidade analisar a legitimidade das políticas de fomento implementadas por empresas estatais brasileiras. Para a sua elaboração, partimos da hipótese de que empresas estatais podem implementar ou ser utilizadas como instrumentos para a implementação de medidas de fomento a atividades privadas que possuam externalidades positivas para a coletividade, sem que isto represente, obrigatoriamente, desvirtuamento de suas funções econômicas típicas. Após analisarmos três experiências de fomento por empresas estatais (PROINFA da Eletrobrás; Petrobrás Socioambiental; e Centro Cultural Banco do Brasil), chegamos à conclusão da legitimidade de tais ações, que podem ser consideradas instrumentos de mercado para o aprimoramento da própria atividade empresarial das empresas estatais.

The purpose of this thesis is to analyze the legitimacy of the encouragement policies implemented by Brazilian state-owned companies. In order to elaborate it, we start from the hypothesis that state-owned companies can implement or be used as instruments for the implementation of promotion measures for private activities that have positive externalities for the community, without this necessarily representing a distortion of their typical economic functions. After analyzing three experiences of fostering by state-owned companies (PROINFA by Eletrobrás; Petrobrás Socioenvironmental; and Centro Cultural Banco do Brasil), we reach the conclusion of the legitimacy of such actions, which may be considered market instruments for the improvement of the business activity of state-owned companies.
