Com a internacionalização do direito administrativo, o controle judicial da Administração Pública sujeita-se à Corte Interamericana de Direitos Humanos. Em tal atividade, o tribunal contrasta condutas omissivas e comissivas do Estado com o paradigma normativo, a Convenção Americana, chegando a uma conclusão de adequação ou inadequação. E no caso de inadequação, impõe medidas corretivas e preventivas. Isso se dá mediante um processo bifásico, que se inicia na Comissão e se conclui na Corte. Analisando as sentenças da Corte, constatou-se compatibilidade entre seu entendimento e o dos tribunais brasileiros sobre institutos de direito administrativo, na maior parte das vezes. O cumprimento das sentenças interamericanas é, no Brasil, dificultoso, pela falta de legislação adequada, criando demoras e franco descumprimento. As grandes dificuldades de acesso ao Sistema Interamericano e no cumprimento de suas decisões indicam que o controle judicial via Corte Interamericana, embora possível, é pontual e factível em poucos casos.

Abstract in English
With the internationalization of administrative law, the judicial control of Public Administration is subject to the Inter-American Court of Human Rights. In such activity, the court contrasts omissive and commissive actions of the State with the normative paradigm, the American Convention, reaching a conclusion of adequacy or inadequacy. In the case of inadequacy, corrective and preventive measures are imposed. This occurs through a two-phase process, which begins at the Commission and concludes at the Court. Analyzing the Court's judgments, compatibility between its understanding and that of Brazilian courts regarding administrative law institutes was found in most cases. The compliance with Inter-American judgments is difficult in Brazil due to the lack of adequate legislation, resulting in delays and open non- compliance. The significant difficulties in accessing the Inter-American System and in complying with its decisions indicate that judicial control through the Inter-American Court, although possible, is sporadic and feasible in few cases.
