O presente trabalho busca apresentar um aporte teórico, normativo e empírico para identificar e lidar com os novos vetores (funções) da jurisdição constitucional. Para tanto, a tese parte inicialmente do arcabouço teórico dos textos constitucionais e percorre os caminhos institucionais da atividade jurisdicional brasileira, especialmente no período republicano, a fim de demonstrar a ausência de supremacia ou do monopólio judicial na resolução de questões, bem como o seu caráter dinâmico à luz dos fenômenos políticos subjacentes. O trabalho se propõe também a fazer uma breve reflexão sobre o dinamismo da cláusula de separação de poderes e estabelecer balizas para uma correta leitura da interpretação do positivismo de Kelsen, fenômenos que se revelam em conformidade com as novas funções dos magistrados na jurisdição constitucional. Nesse processo, as facetas da atuação de juízes e cortes coordenação de interesses e colaboração normativa deverão ser compreendidas a partir do desenho institucional, dos múltiplos incentivos legislativos editados pelo Congresso Nacional e da crescente interação entre os agentes políticos e os magistrados na busca de soluções heterodoxas (mas adequadas) em razão do mosaico fático subjacente. Esse aporte teórico permitirá não apenas uma nova visão acerca da legitimidade, mas também possibilita que se analise, no Brasil, uma nova forma de atuação jurisdicional e política realizada pelo Supremo Tribunal Federal, tanto nas ações de controle abstrato de constitucionalidade quanto em processos originalmente de índole subjetiva.

This work aims at providing a theoretical, normative, and empirical contribution towards identifying and dealing with new vectors (functions) of constitutional jurisdiction. The present thesis intends to achieve this goal by beginning its analysis with the theoretical framework of constitutional texts on the institutional paths of Brazilian jurisdictional activity. Special attention will be given to the Republican period to demonstrate both the absence of supremacy or judicial monopoly in resolving issues as well as the dynamic character of said jurisdictional activity in light of the underlying political phenomena. The work also proposes a brief reflection on the dynamics of the clause of separation of powers and sets guidelines for a correct reading of Kelsens interpretation of positivism, phenomena in accordance with the new functions of magistrates in constitutional jurisdiction. In this process, the recent aspects of the actions of judges and courts coordination of interests and normative collaboration should be interpreted by means of the institutional design, the multiple legislative incentives issued by the National Congress, and the growing interaction between political agents and judges in the search for heterodox (yet adequate) solutions given the underlying factual scenario. This theoretical contribution allows for not only a new view of legitimacy, but also the analysis, in Brazil, of a new form of jurisdictional and political action carried out by the Supreme Court, both in the actions of abstract control of constitutionality and in processes of originally subjective nature.
