A complexidade que envolve a tarefa de conciliar democracia e constitucionalismo tem sido objeto de estudo do direito constitucional desde longa data. A soberania popular que caracteriza a democracia tem limites dispostos pelo constitucionalismo ora estabelecido por um poder constituinte. O vínculo que se constrói entre todos estes conceitos parece sugerir tensões suficientes para os movimentos-chave da contemporaneidade. No entanto, parece haver outra variável tão importante quanto essas apresentadas que não tem sido tão comumente considerada pela literatura. A escalada autoritária com que o mundo se defrontou nos últimos anos provocou algumas perguntas que alguns estudiosos têm tentado responder desde o final do século passado em diferentes regiões do globo. Os impactos do capitalismo, cada vez mais explícitos, abriram novas portas para a reflexão acerca do modelo econômico que dita as regras desde o final da Guerra Fria. O neoliberalismo pode ser encarado como uma etapa do capitalismo ou não, a depender de quem o estuda e é nessa variável, orientada pela economia política, que este trabalho procura se debruçar. O argumento principal defendido pela dissertação é o de que existe um paradoxo entre o neoliberalismo econômico e o par democracia e constitucionalismo. Sendo assim, a adoção deste modelo econômico se estende para além da dimensão do mercado e alcança outras frentes de atuação do Estado. A análise está pautada em uma noção foucautiana do que é o neoliberalismo e como ele se desenvolve, além de procurar compreendê-la com um recorte na realidade brasileira. O foco do trabalho recai sob a Assembleia Nacional Constituinte de 1987-88 - momento em que as relações entre direito, democracia e mercado, bem como suas tensões e forças procuram se reorganizar após uma experiência autoritária ainda recente. O esforço consiste em mapear sob perspectiva histórica as discussões em torno do artigo 170 da Constituição Federal que estabeleceu neste texto os princípios da Ordem Econômica.

The intricacy that surrounds the task of conciliating democracy and constitutionalism has been a constitutional laws object of analysis for some time. The popular sovereignty that typifies the democracy has boundaries laid down by constitutionalism, established already by a constituent power. The bond that is built between all these concepts seems to suggest enough tensions for the key-moments of contemporaneity. However, there seems to be another variable as important as those mentioned, that which hasnt been so commonly considered by literature. The authoritarian escalation that the world has faced as of the last years provoked some questions that some scholars have been trying to answer since late last century in different regions of the globe. The impacts of capitalism, increasingly explicit, have opened new ways for thinking the economic model that has been dictating the rules since the end of the Cold War. Neoliberalism can be faced, or not, as a step of capitalism, depending of who is studying it, and it is this variable, oriented by the political economy, that this research seeks to lean on. The main argument defended by the dissertation is that there is a paradox between the economic neoliberalism and the democracy and constitutionalism pair. Thus, the adoption of this economic model extends beyond the dimension of the market and reaches other fronts of agency from the State. The analysis here is in line with a Foucauldian notion of what is neoliberalism and how does it develop itself, seeking to understand it by the means of a snippet of the brazilian reality. The works focus relapses under the 1987-88 Brazilian Constituent Assembly a moment when the relations between law, democracy and market, as well as its tensions and vectors seek to reorganize after a still fresh authoritarian experience. This effort is consisted in mapping under a historical perspective the discussions revolving the article 170 of the Federal Constitution that established in writing the principles of the Economic Order.
