O enfoque específico desta pesquisa se configura na análise da regulação do ensino superior no Brasil, bem como o mecanismo que envolve essa prática, buscando induzir à reflexão sobre os problemas e as dificuldades enfrentados no desenvolvimento de uma educação superior de qualidade e que cumpra o objetivo de melhorar a vida das pessoas tanto do ponto de vista profissional, quanto do aspecto de exercício pleno da cidadania. O tema integra o contexto do Direito Administrativo, pois suscita a prática rotineira e sequencial de atos administrativos, trata do processo administrativo que norteia a autorização e o funcionamento das Instituições públicas e privadas, de modo que a doutrina e o posicionamento de outras jurisdições foram suplementares para a compreensão do assunto. As pesquisas realizadas na Espanha, nos corredores da Biblioteca Francisco de Vitoria, na Universidad de Derecho da Universidad de Salamanca e a consulta efetivada no livro da lavra da Professora Doutora Maria Tereza del Pilar Jimenez Tello, entirulado Auditoria universitaria y calidad, La evaluacion como conquista social ante la competencia universitaria global. publicado em 2009, fruto da tese de doutoramento elaborada pela Doutora Pilar Jimenez, defendida na Universidade de Barcelona, foram os principais elementos inspiradores para a definição do objeto da pesquisa.

The specific aim of this research is the analysis of the regulation of higher education in Brazil and its mechanisms. We seek to promote reflections on the problems and difficulties faced in fostering quality higher education, that can meet the goal of improving peoples' lives both from the professional point of view and from the perspective of exercising citizenship. The subject is inserted in the field of Administrative Law, since it evokes the regular and sequenced practice of administrative acts, and deals with the administrative process that guides the authorization and the functioning of public and private institutions, in such a way that the doctrine and positioning of other jurisdictions were supplementary for understanding the subject. The researches carried out in Spain - in the Biblioteca Francisco de Vitoria library and in the Universidad de Derecho of the University of Salamanca - and the work on the book of Professor Maria Tereza del Pilar Jimenez Tello (Auditoría universitaria y calidad, La evaluación como conquista social ante la competencia universitaria global, issued in 2009 as a result of the PhD thesis developed by Doctor Pilar Jimenez at the University of Barcelona) were the main motivational elements to define the research object.
