A perspectiva da pesquisa realizada que evoluiu para fundamentar esta tese de Doutorado revela uma acentuada preocupação com a implementação do bom governo, esperança e aspiração da sociedade brasileira. Nesta linha, o trabalho busca examinar o desenvolvimento do princípio da eficiência que, embora tardiamente marque presença no art. 37, da Constituição Cidadã, de 5 de outubro de 1988 (E.C. n. 19/4.06.1998), há longos anos vem sendo tratado e aprimorado no seu conteúdo, na expectativa de respaldar governos que atendam, concretamente, às demandas que emanam da sociedade, às metas de interesse público e ao bem comum, ou seja, o desenvolvimento da sociedade, dos grupos e setores que a integram e de cada um dos indivíduos. Percorrendo a história das instituições, examinando a trajetória do Direito Administrativo, disciplina a albergar o estudo dos princípios de regência da atividade administrativa e, em especial, do cânone da eficiência, detendo um especialíssimo olhar sobre as propostas de Reforma do Estado, este trabalho oferece ao leitor uma visão das medidas e providências que foram adotadas e dos projetos em desenvolvimento, com vistas a tornar a eficiência do Estado uma realidade, retirando-a do plano de hibernação, de mero sonho dos governados. Mais até, a tese aponta a judicialização das questões atinentes à eficiência das ações do Poder Público como a ferramenta mais eficaz, até o momento, para tornar efetivas as políticas públicas exigidas pela sociedade, por via de reclamos esparsos, contínuos e sempre atendidos pelo Poder Judiciário. Este, portanto, em pleno exercício de atividade imprópria, passa a produzir decisões de perfil político, até há poucos anos reservadas aos Poderes Legislativo e Executivo. Ao decidir, contudo, o Judiciário se transforma, assumindo o papel de concretizador da eficiência administrativa, por implementar medidas que os governados aguardam. Enfim, assume o Judiciário a postura de ferramenta a impor ao legislador e à Administração Pública o respeito e o dever de garantir a eficiência de sua atividade.

The topic of this research that eventually configured the basis of this Doctoral Thesis is keenly concerned with a common hope of the Brazilian society: the implementation of good government. Accordingly, this work examines the elaboration of the principle of efficiency enshrined in the Article 37 of the 1988 Brazilian Federal Constitution. Despite its late inclusion, the 1988 Brazilian Federal Constitution was enacted in October 5th, 1988, whereas the principle of efficiency was introduced through the 19th Amendment of 1998. Its content has been intensely discussed and developed with a view to providing a workable framework for governments to meet the demands of society, to promote public interest objectives and to ensure the common good. In a word, to promote the development of the various groups and the individuals that compose society. From a historical narrative for the institutional history of Administrative Law, which studies the principles that regulate administrative activities, specially the tenet of efficiency, this work sheds light on State reform proposals and offers a perspective on the policies and measures adopted, as well as on various development projects, in order to transform the abstract (and somewhat dormant) concept of efficiency into a concrete reality. This thesis also maintains that the effectiveness of the public policies on the community demands has best been addressed by judicial response to issues regarding the efficiency of the initiatives implemented by the Public Administration, as the Judiciary Branch usually answering the continuous stream of cases. Faced with a task they were not meant to perform, courts have begun to dictate politically motivated rulings, thus exercising powers that traditionally fell in the exclusive province of the Legislative and Executive Branches. By playing this role, however, the Judiciary Branch has reinvented itself into an agent of administrative efficiency that must meet the expectations of society regarding policy implementation. In conclusion, the Judiciary Branch has become an instrument to ensure the Legislative Branch and Public Administration to honor their duty to conduct their activities efficiently.
