A presente pesquisa tem por objetivo estudar o controle das normas internacionais de direitos humanos incorporadas ao ordenamento jurídico brasileiro, especialmente o controle de convencionalidade.Nesse sentido a Constituição de 1988, ganhou novos contornos com a inserção de documentos internacionais, inicialmente na matéria inscrita no art. 5º, § 2º, da Constituição Federal, após a Reforma do Poder Judiciário com a Emenda Constitucional nº 45/2004, de 8 de dezembro de 2004: a inserção do § 3º no art. 5º a hierarquização constitucional dos novos documentos internacionais (tratados e convenções) de direitos humanos.Uma vez realizado o estudo dos § 2º e § 3º do art. 5º a pesquisa tratará do bloco de constitucionalidade e de sua aplicação na doutrina e jurisprudência brasileiras. Por fim, este trabalho analisará o controle de convencionalidade no que se refere a sua execução, seja pela Corte Interamericana de direitos humanos, seja por países latino-americanos, inclusive pelo Brasil.

The objective of this research is to study the control of international human rights standards incorporated into the Brazilian legal system, especially the control of conventionality.In this sense, the Constitution of 1988, gained new contours with the insertion of international documents, initially in the matter inscribed in art. 5th, paragraph 2º, of the Federal Constitution, after the Reform of the Judiciary with Constitutional Amendment 45/2004, of December 8, 2004: the insertion of Paragraph 3º in art. 5th, the constitutional ranking of new international documents (treaties and conventions) on human rights. Once the study of paragraphs 2º and 3º of art. 5th, the research will deal with the constitutionality block and its application in Brazilian doctrine and jurisprudence. Finally, this paper will analyze the control of conventionality regarding its execution, be it by the Inter-American Court of Human Rights, or by Latin American countries, including Brazil.
