O direito fundamental à não autoincriminação não é expresso em declarações de direitos, mas pode ser deduzido de um processo interpretativo, que parte da generalização das razões do direito ao silêncio e do desdobramento de outros direitos fundamentais, em especial do direito à não autoincriminação e do direito à privacidade. Essa dedução é adequada ao processo de evolução dos direitos fundamentais e está em conformidade com o papel da jurisdição constitucional. O direito à não autoincriminação pode ser desdobrado em quatro normas jurídicas, que ora se comportam como proteção absoluta, ora como proteção prima facie, contra a coação a colaborar com a proteção de provas com potencial autoincriminatório: (i) direito a não participar da produção de provas em uma investigação ou processo em curso; (ii) direito a não ser sancionado pela negativa em participar da produção da prova; (iii) direito à inadmissibilidade das provas obtidas mediante coação; e (iv) direito a não fornecer elementos com potencial de dar notícia da própria responsabilidade criminal. O direito a não participar da produção de provas em uma investigação ou processo em curso diz respeito à produção da prova ela mesma, mediante uso de meios que buscam substituir a vontade do imputado para cooperar coação direta. É uma proteção absoluta quanto a provas declarativas, e prima facie quanto às demais provas. O direito a não ser sancionado pela negativa em participar da produção da prova consiste em não sofrer sanção de qualquer tipo, interna ao processo ou externa, em razão da negativa. Quanto a provas declarativas, é um direito absoluto, ainda que com exceções decorrentes de seu abuso. Quanto a provas não declarativas, é um direito prima facie. O direito à inadmissibilidade, em processo criminal, das provas obtidas mediante coação, em processo não criminal, protege contra o uso de provas em procedimentos nos quais a autoincriminação não se aplica processos cíveis ou administrativos em processos criminais. É um direito absoluto, não importa qual o tipo de prova em questão. O direito a não ser obrigado a colaborar com elementos com potencial de dar notícia da própria responsabilidade criminal é um direito prima facie, independentemente de a prova em questão ser declarativa ou não.

The right against self-incrimination is not expressed in any bill of rights, but can be deduced from an interpretative process, from the generalization of the reasons for the right to silence and other fundamental rights, in particular the right to non-self-discrimination and right to privacy. This deduction is appropriate to the process of evolution of fundamental rights and is in line with the role of constitutional jurisdiction. The right against self-incrimination can be broken down into four legal norms that sometimes behave as absolute protection, sometimes as prima facie protection, against coercion to give evidence with self-incriminating potential: (i) the right not to participate in the production of evidence in an ongoing investigation or process; (ii) the right not to be sanctioned for refusing to participate in the production of the evidence; (iii) the right to inadmissibility of evidence obtained through coercion; (iv) the right not to provide elements with the potential to report criminal responsibility. The right not to participate in the production of evidence in an ongoing investigation or process concerns the production of evidence itself, through the use of means that seek to replace the will of the accused to cooperate - direct coercion. It is absolute protection for testimonial evidence, and prima facie for other evidence. The right not to be sanctioned for refusing to participate in the production of evidence is not to suffer any type of sanction, internal to the process or external, due to the refusal. As for testimonial evidence, it is an absolute right, albeit with exceptions arising from its abuse. As for non-declarative evidence, it is a prima facie right. The right to inadmissibility, in criminal proceedings, of evidence obtained through coercion, in non-criminal proceedings, protects against the use, in criminal proceedings, of evidence produced in procedures in which selfincrimination does not apply civil or administrative proceedings. It is an absolute right, no matter what type of evidence in question. The right not to be obliged to collaborate with elements with the potential to report criminal responsibility is a prima facie right, regardless of whether the evidence in question is declarative or not.
