No presente trabalho, tem-se por objetivo a busca de soluções possíveis para a superação da inconstitucionalidade provocada pela omissão legislativa relativa, em que o legislador, ao regular determinado fato, estabelece direitos, benefícios, deveres ou obrigações para uma dada categoria ou grupo de pessoas, abstendo-se de aplicar o mesmo regime a outra categoria ou grupo de destinatários que esteja em situação igual ou de identidade juridicamente relevante. Considerando que as omissões relativas derivam de uma violação ao princípio da igualdade, e não da violação, por inércia, do dever constitucional de legislar, será demonstrado que o seu próprio conceito destoa, em parte, dos pressupostos utilizados para conceituar as demais omissões. Assim, partindo-se da premissa de que o controle da omissão relativa deve ser feito pela via de ação, será constatado que há espaço limitado, no sistema de controle brasileiro, para a prolação de decisão com efeitos aditivos, com a consequente extensão da norma às categorias de sujeitos excluídos de forma ilegítima, embora ainda seja extremamente necessária a sistematização de técnicas de decisão aptas a solucionarem a inconstitucionalidade decorrente da omissão relativa, sem eliminar a norma do ordenamento jurídico.

This paper seeks possible solutions to overcome the unconstitutionality stemming from relative legislative omission, in which the legislator, in regulating a certain fact, establishes rights, benefits, duties or obligations for a given category or group of individuals, but refrains from applying the same rules to another category or group in the same situation or of a legally relevant identity. Considering that relative omissions derive from a breach of the principle of equality, and not from the breach, by inertia, of the constitutional duty to legislate, it will be shown that their own concept is just partly based on the assumptions used to define other omissions. Thus, based on the premise that the control of relative omission must be done by means of action, it will be noted that there is limited space in the Brazilian control system for decisions with additive effects, with the consequent extension of the rule to categories of individuals illegitimately excluded, even though it is still extremely necessary to systematize apt decision-making techniques to solve the unconstitutionality resulting from the relative omission, without eliminating the rule of law.
