A presente dissertação se dedica a analisar, à luz do Direito Constitucional e do Direito Administrativo, o papel do Estado no processo de internacionalização das empresas, por meio da promoção de políticas públicas indutoras ou facilitadoras que encontram na atividade administrativa de fomento uma eficiente ferramenta para o desenvolvimento nacional. Em um cenário originado a partir das últimas décadas do século passado e com mudanças ainda correntes, o incentivo à exportação de serviços brasileiros em infraestrutura se designa não apenas a ajudar as empresas particulares, mas produz reflexos coletivos na ordem econômica interna, e desse modo privilegia o interesse público. Neste contexto, é determinante a função institucional do BNDES na gestão de recursos públicos: a partir de normas transparentes e isonômicas, submetidas a adequado controle formal e de resultados, a instituição tem possibilitado que um grande número de países se tornem destinatários de serviços de infraestrutura prestados por empresas brasileiras. A inclusão de Cuba neste mercado transnacional - por meio da criação da ZEDM e ampliação do porto de Mariel - se apresenta como um modelo a ser investigado.

The present dissertation analyzes the role of the State in the process of internationalization of companies according of Constitutional Law and Administrative Law, through the promotion of inducing or facilitating public policies, and finding in the administrative activity of development an efficient tool for national development. In a scenario that originated from the last decades of the last century and with changes still in progress, the incentive to export brazilian services in infrastructure is not only designed to help private companies, but produces collective reflexes in the domestic economic order, and thus privileges the public interest. In this context, the institutional role of the BNDES in the management of public resources is decisive: from transparent and isomorphic norms, and submitted to adequate formal and results controls, the institution has enabled a large number of countries to become recipients of infrastructure services provided by brazilian companies. The inclusion of Cuba in this transnational market - through the creation of the ZEDM and expansion of the Mariel port - is presented as a model to be investigated.
