Esta tese analisa a institucionalização de sistemas de políticas públicas no Brasil. Reconhecendo que a Constituição de 1988 promoveu inflexões significativas em relação ao paradigma de bem-estar social e ao arranjo federativo vigentes até então, examina-se a emergência e a disseminação do modelo de sistemas únicos ou sistemas nacionais como parte da construção do Estado social brasileiro pós-1988. Visando compreender os fatores que influenciam a implantação e a resiliência de políticas sob a forma de sistemas, a pesquisa reconstitui as transformações que resultaram no Sistema Único de Saúde, no Sistema Único de Assistência Social e no regime de colaboração na educação básica, incluindo os movimentos na direção do Sistema Nacional de Educação, tendo em atenção quatro fatores jurídico-institucionais: legado pré-constitucional das políticas em estudo, base constitucional das políticas sociais, estruturas tripartites de pactuação federativa e instrumentos de coordenação nacional das políticas públicas. Em linhas gerais, conclui-se que fatores jurídico-institucionais explicam a variação dos resultados alcançados pelo Estado brasileiro em seus esforços de organização de sistemas de políticas públicas voltados para a efetivação de direitos sociais e que, uma vez implementados, esses arranjos contam com uma capacidade de resiliência comum às diversas áreas que o adotam, advinda da interdependência federativa inerente ao modelo institucional em questão. Evidenciada a importância do arcabouço jurídico para conferir coesão e estabilidade aos arranjos jurídico-institucionais avaliados, propõe-se ainda um quadro de referência para exame da institucionalização de sistemas de políticas públicas. Por fim, argumenta-se que as transformações engendradas nas políticas estruturantes de saúde, assistência social e educação e a convergência delas na direção do modelo dos sistemas não são apenas aprimoramentos de políticas setoriais, mas sim o processo aluvial de construção do Estado social brasileiro à luz da Constituição de 1988.

This thesis analyzes the institutionalization of public policies systems in Brazil. Acknowledging that the 1988 Constitution brought significant inflections concerning the social welfare paradigm and the federative arrangement, the emergence and spreading of unified systems or national systems model is examined herein as part of Brazilian Welfare State building after 1988. In order to understand which factors influence the implementation and the resilience of policies organized as systems, the research rebuilds transformations that led to the Unified Health System, the Unified Social Assistance System, and the regime of collaboration in basic education, including the movements towards the National Education System, taking into account four legal-institutional factors: pre-constitutional legacy of the policies under investigation, constitutional basis of social policies, tripartite interfederative decision-making structures and public policy instruments for national coordination. In short, the thesis concludes that legal-institutional factors explain the variation in the outcomes achieved by the Brazilian State in its efforts to organize public policy systems aimed to enforce social rights and that, once implemented, these arrangements have a resilience capacity, common to different areas that adopt it, arising from the federative interdependence inherent to the institutional model. Once highlighted the importance of the legal framework to provide cohesion and stability to the legal-institutional arrangements evaluated, it is proposed a reference framework to evaluate the institutionalization of public policy systems. Finally, it is argued that the changes engendered in the structuring policies of health, social assistance and education, and their convergence towards the systems model are not only improvements of sectorial policies but also the alluvial process of construction of the Brazilian Welfare state, in line with 1988 Constitution.
