Esta tese analisa a disciplina jurídica do financiamento público à inovação empresarial. Essa forma de transferência de recursos públicos a empresas privadas para fins de fomento foi examinada em seis capítulos, tendo sido adotados enfoques teóricos (capítulo 1 e 2), dogmáticos (3, parte do 5, e 6) e empíricos (4 e restante do 5). Assim, foram: (i) abordados conceitos necessários à compreensão dos financiamentos e promovida a sua contextualização no cenário nacional; (ii) apresentados seus traços característicos e o arcabouço normativo que os condiciona, inclusive em razão dos instrumentos jurídicos escolhidos para promovê-los; e (iii) delineados e discutidos aspectos da sua prática, por meio do exame de minutas contratuais padronizadas. O desenrolar da pesquisa permitiu concluir que a interação entre arcabouço teórico, condicionantes normativas e imperativos práticos produziram um todo coerente constitutivo de um regime jurídico próprio.

This dissertation analyzes the legal framework applicable to the public funding of corporate innovation. This form of government funding to promote innovation was examined in six chapters using theoretical (chapter 1 and 2), normative (3, 5, and 6), and empirical (4 and 5) approaches. Were thus presented: (i) key concepts and contextualization of this form of public financing; (ii) its distinctive traits as well as legal rules applicable and financial instruments used to implement it; and (iii) a discussion about its practice, taking standardized contracts as a reference. The research concluded that the interaction between theory, norms, and practice effectively creates a legal regime of its own.
