O Ministério Público brasileiro, tradicionalmente incumbido da defesa dos interesses da Coroa, da Fazenda e da promoção da ação penal, recebeu, com a Constituição de 1988, tratamento normativo inovador. Torna-se instituição singular, quando comparada às congêneres de outros países, independente em relação aos Poderes Executivo, Legislativo e Judiciário e responsável pela defesa do regime democrático e dos interesses sociais, aqui incluído o direito à educação. A partir da experiência prática do autor, Promotor de Justiça, o trabalho desenvolve reflexão crítica e autocrítica a respeito da organização institucional do Ministério Público para a defesa do direito à educação. A análise da evolução histórica e legislativa do Ministério Público brasileiro busca identificar uma possível vocação - ou a ausência desta - para a defesa de direitos sociais, notadamente os das classes cujos direitos fundamentais são historicamente negados, além de apontar os desafios decorrentes das significativas mudanças projetadas no texto constitucional de 1988. Prossegue a pesquisa com o exame das condicionantes jurídicas, políticas e econômicas atuais e o papel do Ministério Público na defesa do direito à educação em cenário de globalização, neoliberalismo e crise do Estado Nacional. Para o exame crítico do atual arranjo institucional e apresentação de subsídios para seu aperfeiçoamento, passa-se ao estudo da evolução histórica da educação e do direito à educação no Brasil, identificando-se os principais debates, interesses em disputa e obstáculos à sua concretização como direito público, gratuito e de qualidade, tal como posto na Lei Maior. Os fenômenos da juridificação e judicialização da educação e a crítica ao modo atual de organização e atuação do Ministério Público em matéria de políticas públicas educacionais são também objeto de análise nesse contexto. O último capítulo, em exame de dados estatísticos, experiências práticas, pesquisas e doutrina sobre a atuação do Ministério Público e sobre diversos aspectos da educação brasileira, trata de explicitar alguns dos problemas que impedem maior eficiência da instituição na defesa do direito à educação, apontando obstáculos decorrentes da própria organização institucional e possíveis caminhos para novos arranjos e modos de agir. Nesse sentido, são discutidas questões como os princípios de independência funcional, obrigatoriedade de agir, planejamento participativo, taxonomia, organização e publicação de repertório de casos, a regionalização e a especialização de Promotorias de Justiça exclusivamente dedicadas ao tema da educação, pretendendo-se, assim, oferecer subsídios teóricos e práticos para o aperfeiçoamento da instituição em sua função de contribuir para a concretização do direito à educação.

The Brazilian Public Ministry, traditionally charged with the defense of the Crown and the Treasury interests and the promotion of criminal actions, gets an innovative normative treatment with the Constitution of 1988. It becomes a unique institution when compared to its counterparts in other countries, independent of the Executive, Legislative and Judiciary Powers, and responsible for defending the democratic regime and social interests, including the right to education. Based on the author's practical experience as a Public Prosecutor, this study develops a critical and a self-critical reflection on the institutional organization of the Public Ministry for the defense of the right to education. The analysis of the historical and legislative evolution regarding the Brazilian Public Ministry seeks to identify possible vocation - or the absence of it - to the defense of social rights, especially those of the classes whose fundamental rights have been historically denied, as well as to point out the challenges arising from the significant changes designed in 1988's Constitutional text. The research also focused on the examination of the current legal, political and economic conditions and the role of the Public Ministry in the defense of the right to education in a scenario of globalization, neoliberalism, and crisis of the National State. For the critical analysis of the current institutional arrangement and the presentation of subsidies for its improvement, we proceed to the study of the historical evolution of the education and the right to education in Brazil, identifying the main debates, the interests at stake and the obstacles to its achievement as a public right, with quality and free of charge as set out by the Constitution. The phenomena of juridification and judicialization of education and the criticism of the current way of organization and performance of the Public Ministry in matters of educational public policies are also object of analysis in this context. The last chapter, based on an examination of statistical data, practical experiences, researches and doctrine about the performance of the Public Ministry and several aspects of Brazilian education, aims to explain some problems of effectiveness in the defense of the right to education by the institution, pointing out possible obstacles arising from the institutional organization itself and possible ways to new arrangements and more efficient performance. In this sense, issues such as the principles of functional independence, obligation to perform, participatory planning, taxonomy, organization and publication of case studies, regionalization and specialization of Public Prosecutor's Offices exclusively dedicated to the topic of education are discussed, aiming to offer theoretical and practical subsidies for the improvement of the institution in its role of contributing to the implementation of the right to education.
