A presente pesquisa tem por objetivo analisar as ações do Estado voltadas à universalização do acesso à internet na perspectiva do direito administrativo. Abordam-se temas preliminares à questão de fundo, que perpassam pela construção do acesso à internet como um direito essencial ao exercício da cidadania, bem como pelas considerações tecidas a respeito da universalização enquanto categoria jurídica que se identifica como princípio. Assumindo o modelo regulatório das camadas da internet, adota-se o recorte da camada física para estudo de aspectos relativos ao desenvolvimento da infraestrutura e desdobramentos institucionais entremeados pela disciplina jurídica conferida à atuação estatal segundo os perfis propostos regulatório e desenvolvimentista. Por meio de sua consideração como bem infraestrutural e em atenção à dimensão de sua função social, investigam-se as concepções teóricas associadas às redes, perscrutam-se modelos de acesso e os instrumentos empregados para seu direcionamento segundo o objetivo de universalização, assim como a configuração nacional de capacidades institucionais dos programas de ação pública dedicados à promoção da universalização do acesso à internet. Extraem-se ilações relevantes a respeito da orientação estatal dirigida a referido objetivo, notadamente quanto aos atributos e desafios jurídicos para o desenvolvimento das redes. Defende-se que a discussão sobre o papel do Estado nesses quadrantes transcende a mera predileção por um regime jurídico de direito público ou privado, e concentra-se na atuação voltada à constituição de arranjos jurídico-institucionais coerentes e apropriados às necessidades e ao contexto nacional, assim como em atenção à dependência do percurso e aos parâmetros da legalidade, racionalidade e neutralidade tecnológica.

This research aims to analyze the actions of the State linked to the universalization of internet access from the perspective of administrative law. Preliminary themes are addressed to the fundamental question, which pervade the construction of internet access as an essential right to the exercise of citizenship, as well as the considerations made about universalization as a legal category identified as a principle. Assuming the regulatory model of the internet layers, the concepts based on the physical one are adopted to study aspects related to the development of infrastructure and institutional unfoldings interspersed by the state action legal discipline according to the proposed profiles regulatory and developmental. Through its consideration as an infrastructural asset and in attention to the dimension of its social function, the theoretical conceptions associated with networks are investigated, as well as models of access, the instruments used to guide them according to the objective of universalization and the national configuration of institutional capacities of public programs dedicated to promoting universal access to the internet. Relevant conclusions are drawn about the state guidance aimed at that objective, notably as regards the legal attributes and challenges for the development of networks. The argument suggests that the discussion of the role of the State in these quadrants transcends the mere predilection for a legal regime of public or private law, and rather focuses on action aimed at the constitution of legal and institutional arrangements that are coherent and appropriate to the national needs and in attention to the path dependence and the parameters of legality, rationality and technological neutrality.
